So if you take out a 2 yr cell contract and you want to upgrade later, the SP normally let you do this 3 months before the original contract expires (or that is how it use to work - does this still apply?)

If you do that your 3 months will be added to the new 24 month contract = 27 months.

I phoned MTN hotline to check when I'm due for an upgrade again and the lady with the machine voice reckon 9 April 2013 should be fine. Upon checking my written contract I noticed it was signed on the 10 Aug 2011 so in my mind this contract ends 10 Aug 2013. So 4 months earlier for upgrade. Do they do this with all concurrent contracts?

What happens when you want to port to a different SP. Will they give you a surprise after you think your contract expired and say no wait you have an additional 9 months to go (left over months from previous contracts due to early upgrades?)
 
Perhaps check what the Consumer Protection Act says. Things have changed but I don't have the latest information at hand.
 
maybe it's only applicable for 2 yrs, meaning that you have to run the second contract out with the additional months left from previous contract before you can upgrade again
 
You can upgrade earlier but the total length of the existing period and the renewed period will still be 48 months.
