Changes to existing contracts?

I found my PDF; I cannot find anything concerning the speed in the contract. Except that there is no guarantee that our expectations will be met... WHOOOAA, they knew it all from the start!
 
OH, I should add that the PDF has lost its data, so, the "128kbps line @ R" line is not there anymore, but now that Luke has mensioned it, it does ring a bell.

No problemo, everything gets forwarded after spam & virus checking to my gmail account anyways & so far it says:
"You are currently using 24 MB (2%) of your 1000 MB."
so methinks there be enough spacies for nog 'n 400K :)

:) Yep I know - I was just saying it can stay in my gmail account until iBurst starts behaving itself - I think 400KB wouldn't be too difficult - but certainly easier than trying to get an email with a 2MB attachment into ThunderTweety seems to cause repeated failed attempts - well any large attachment keeps timing out...:(

Send me the file, I will quickly go & hold the new extant out the window & maybe ThunderTweety won't sing me depressing songs of winter :D
 
There was nothing in the original contract specifying the speeds, there was a clause though that you are supposed to accept it even if the speeds degrade to almost nothing. Sentech pulled a "bait and switch" from the start - they planned it all ahead - start with great bandwidth, get people to sign contracts, and then pull the plug on the bandwidth.

So the contract protects them, seemingly; however, they did use false advertising (claiming uncapped, unshaped, unlimited 128k/256k/512k speeds) to get people to sign the contracts - couldn't this be argued as being reason to nullify the contracts, as they were signed under false pretences / fraudulent claims? Any lawyers here?

To those of you that are debating the merits of the Sentech contract, be
advised that if you had read all the small print, you would have discovered that
all rights were vested with Sentech, to do as they please, as long as they
listed these "changes" on their website.

So basically, they don't have to inform anyone directly (they didn't) and they
can change the status any point in time.
This style of contract is pretty much the same as what Telkom have
been dishing up to their customers for decades!
A close look at many other ISP contracts will reveal a similar clause.
Only when a change of culture in customer relations in SA takes place
(We are not demanding enough) will you see contracts that protects the customer too.
Until then ..... it's simply a matter of biting the bullet!

There's legalities and then there's PR......Sentech would be hard pressed to justify their Bait & Switch in the public domain....
 
The fact is that most of what appears in such contracts never gets read by Joe/Jane Public, there are a number of psychological engineered tactics employed by the contract lawyer fraternity
  • Microscopic print (aka fineprint which aint well & fine or dandy @all)
  • Legaleeze (I was tempted to add in sl in there - no offence to our legal eagle forumites ;)) - this is all the fancy poncy words that belong in an English/Latin/Greek woordeboek.
  • Deliberately long-worded which tends to make people feel like taking a grandpa powder & having an afternoon nap :D
  • I have also noticed a tendency to use low contrast printing tactics - for example light green text on a white background - which makes it more difficult to read & generally people switch off & say what the heck & just sign on the dotted/solid line...
 
Yep, me still interested :) - I actually intend to get the latest from GeenDraad & compare their old & new (just want to know if Sentech had forced them to make any downline contractual changes...).

arf9999, Let's be blunt: Sentech, like Telkom are still very much in the
parastatal mindset. They usually don't give a *&%%$ about PR, simply
because they don't have to.
In the case of Sentech, the state owns 100% of the company, and their
strategy currently does not aim to please all their customers (clearly not
power users who are going to eat into expensive international bandwidth).

Sentech are currently about to extend a major roll-out of their technology as
part of a policy of government to provide wide network coverage as quickly
as possible. "High end" Customers are clearly not a strategy for Sentech,
and if anything, I believe that this product will be aimed mostly at two
types of users.
1. Low intensity users, but with a 24 hours a day requirement.
2. Casual users but with some form of qos/voip requirements.

Expect to see:
New cheaper low end offerings and also some entry level Corporate offerings
(i.e. small branch office) that are not bandwidth eaters.

Time will tell!
 
Here's a fun way of hurting Sentech in the public eye, AND finding out the actual legal status AND advertising this forum:

702 Radio have a program called 'Legally Speaking' - I dont know what night its on. However, find out by looking at their online schedule - then EVERYONE hogs the phones until someone gets through, and asks the legal expert in the studio, live on air, this question about Sentech and their changing of the contract.
An initial call, followed by lots and lots of forumites all complaining about Sentech, will go a long way to killing them and flushing their adspend down the toilet..
