CNA - cellphone refund

I bought a cellphone from CNA three days ago, and when I took it home found I still had an old (nicer) cellphone
Usually clothing retailers will allow you to return stuff on a whim or if you suffer a case of buyer's remorse. I guess that doesn't extend to cellphones.

Clothing can just go back on the rack. Don't think CPA covers buyers remorse. But if the phone is still sealed then CNA are being dicks.

...
So am I expecting a bit much to get a refund (or even exchange, for lots of gift cards!), when it effectively is a form of buyer's remorse?

CPA does not cover buyers remorse and thats what you have with regards to your purchase.

Don't blame the retail store for a bad decision on your part.

Out of interest, what phone is it and how much did it cost?

It's a Nokia Asha 300, R1100. If it was a very nice phone and did what I needed, I wouldn't be looking for a refund, but I bought it thinking it was a bit more capable than it is, before coming home to realise that my old (though high-end) Sony Ericsson still existed, and was nicer to use. So apart from buyer's remorse, I bought the phone with an overly optimistic view of its capabilities...

Okay, so you're in it for a decent amount. I'd say it'd be worth chancing your luck and taking it to the store manager and quoting a bit of CPA at him/her.

Failing that, a gift for a loved ones birthday or something :)

How do you forget you own a cellphone? I only ever have one at a time.

New Phone every 2 years, going on 16 years, with several spares bought every couple a years, and you
end up with drawers full of old phones, that you cannot give away.

CPA doesn't cover buyer's remorse.

ECTA does not apply to transactions "in real life" for lack of better description.

Unfortunately you won't come right at all Edcon/Edgars cover there back so well I purchased a phone from them last year around June/July and had to sign a document that they won't take back the phone for a refund or anything as such. I still have the copy somewhere and I did tune him about CPA but the consultant didn't seem bothered at all and this is a new thing that came into the picture. I remember purchasing a phone from them in January 2011 and I didn't have to sign any such document. Just very surprised to be honest.

The consultant also open the phone to check that everything is in working order and they RICA a simcard for you which I think is totally wrong as you already have a simcard, hopefully they recycled the number by now

So in other words you made a mistake and now CNA must pay for it? What do you think happens to that open package used cellphone? Some other customer must buy it? Would you buy an open package phone that has been returned (with damaged packaging most likely?). These things don't just get swept under the rug for your convenience you know. This pretty much amounts to free cellphone rental in the "retailers eyes".

The product was not misrepresented to you. You approached CNA. You bought it with full knowledge of it's capabilities. Chalk this one up to experience and don't be so hasty with your purchases the next time.

They could easily sell the phone at a discounted price as a demo model, yes they will lose some profit, but as any good company should they budget for these kinds of loses.

Why exactly must they do this.

There is nothing wrong with the phone... I know I for one wouldn't budget for "buyers remorse" or anything of the sort. You bought it, its yours.
