One of the accused‚ Theo Jackson‚ on Thursday told the High Court sitting in Middelburg that Victor Mlotshwa’s bag containing the rolls of stolen copper cables had since been given away.

“I gave it to one of my employees‚” Jackson said.

What if Mlotshwa was also given the bag of "stolen copper cables" by someone, it looks like giving away alleged stolen goods was not a problem for the accused, or he doesn't like the employee he gave the goods to and he is hoping he gets caught by other farmers and put into a coffin.

He clearly lied under oath. The GPS evidence clearly shows that the Mlotshwa's claims are horsepucky, and that the 2 that put him in a coffin for 5 minutes weren't lying.

He was trespassing.
He lied about his 'attack' *under oath*.

Jail time.

Coffin assault victim's life never in danger, defence argues

Middelburg - There is no likelihood that coffin assault victim Victor Mlotshwa could have died when he was forced into a coffin by two men, the High Court sitting in the Middelburg Magistrate's Court heard on Monday.

"It is more likely to scare Mlotshwa... the accused never assaulted Mlotshwa, they never intended to assault (him)," Advocate Wayne Gibbs, for Willem Oosthuizen, told the court in his closing argument.

Oosthuizen and Theo Jackson are facing charges of kidnapping, assault with intent to do grievous bodily harm, attempted murder, and possession of an illegal firearm.

Gibbs argued that the accused had to act when Mlotshwa allegedly threatened to burn their crops every year and murder their wives and children.

He said the accused would not have fetched a coffin if they had wanted to murder Mlotshwa.

"It just doesn't make sense to me," he said.

Meanwhile, Advocate Org Basson, for Theo Jackson, argued that when his client burnt the coffin that was used during the incident, he was only following instructions from his boss.

He said the accused had taken Mlotshwa to the secluded area only to threaten him, and not to kill him.

But Prosecutor Robert Molokoane said the accused should be found guilty on all charges.

He said if their intention was not to kill Mlotshwa, the men would have taken a video of the suspected stolen copper cable.

During his testimony, Jackson told the court that he was told to "get rid" of the coffin because it was causing trouble.

"Hannes [de Beers] said I should get rid of it [coffin] because I am making trouble with it."

"At the time when you burnt it, you knew that there was a body which had been put in the coffin?" Molokoane asked.

"Yes, that is correct," he replied at the time.

The coffin would have been used as crucial evidence in the case.

Jackson also said, although they had taken a video and photographs of Mlotshwa, they hadn't taken photographs of the suspected stolen copper cable that they allegedly found in Mlotshwa's possession.

Knobkerrie

They also did not take photographs of the knobkerrie that Mlotshwa said they had used to assault him. Mlotshwa alleged that the two men had tied him up with cable ties, assaulted him with clenched fists and a knobkerrie, and kicked him all over his body.

During his evidence-in-chief, led by his lawyer Org Basson, Jackson said he never considered what they did to Mlotshwa as wrong.

Mlotshwa had previously testified that Jackson had made use of the knobkerrie to assault him all over his body, but "mostly on the back".

He also said the two had used cable ties to restrain him.

Jackson said on September 7, 2016, when they apprehended Mlotshwa, that Oosthuizen had threatened to take him to the police, however, Mlotshwa had begged them not to take him to the police.

The men were granted R1 000 bail in July after reapplying.

Judge Segopotje Mphahlele is expected to deliver judgment on Friday.

I fully agree, but given the state of the police and justice system, you can see why people can act this way. If they had done the right thing, this thief would have most likely been sent to prison for a trivial amount of time, then be released on parole without any remorse whatsoever, free to continue whatever he was doing.

As horrible as this whole circus was, you can bet this individual won't be committing any crime again.

That has nothing to do with this case. Here it is about a thief who got exactly what he was looking for, and some morons who thought they could scare somebody and record that and nothing will happen to them. Both sides should be thrown in jail.

I grew up on a farm, the early/mid 90s. The same justification was used back then, to deal out adhoc justice on anyone that was caught trespassing. No one has the right to deal out their version of justice. No matter how justified you might feel. Yes, our justice/correctional service system is screwed up, but its way better than having a society were individuals think they are the law.

Summary, no outcry when blacks attack, torture and murder whites and nothing happened to this black idiot/thief/criminal yet there is a huge outcry because he got bullied a bit.

That's not evidence and there is no reason to contest it as he is not the one on trial. Just interesting that people think he is guilty despite no evidence while simultaneously thinking the actual perps should get off easy despite video evidence. But we're not racist here, oh no...

If he was innocent, it would have been brought up in court because it was the reason why he was supposedly assaulted. Surely if he was innocent they would have tried to push that agenda but that hasn't been the case. I think you just have to accept that everybody, even the prosecutors admit that he was a thief.

If that system doesn't work, people will act out according to their own law because having a society where theft, murder and rape is rampant is less tolerable than having a society where everyone carries out their own justice for theft, murder and rape.
There is overwhelming evidence for this in this country and it will get worse unless if the system is fixed.

Of course nothing will be done by the ANC because their system of having the police, correctional and justice system accountable to people 2000km away in a different province is perfect and if you say anything to the contrary, you are neo-imperialist and obviously racist.
