Contract problems.

Hi guys,

I'm in a bit of a problem with MTN and hoping someone could advise me on here. Basically I have a limit implemented on my contract so that when my "free" airtime value is used up I'm supposed to be cut off. Now the problem I have is that this feature doesn't work properly and I got billed in excess of R500 last month.

I went to the MTN store and they said that this feature doesn't work properly and sometimes can go over by R20 to R30. I complained about this bullcrap as I went over R500 and I told them they must credit the account due to their negligence otherwise there's gonna be k@k.

What legal avenues do I have that I can use to battle them?
 
When the Consumer bill kicks in in October this sort of conduct from suppliers will be illegal. MTN had better sort out their billing before October.
 
you have no legal grounds here, sorry mate. Terms and conditions on the bill limit for state that MTN wont be held liable for any over use over and above the limit stated. As part of junior management i faught many a verbal battle with clients on this one.

Ok. But if the client signed a TopUp contract and it's not a TopUp. Then MTN is liable, or not?

Oh yeah. Try me. I have an outstanding account of nearly R2000.00 since April LAST year. I can PM you my details and then you can try me legally. Actually, I CHALLENGE you to do this.
MTN has left me be even after their lawyers letters as they know they cannot win. I know the law better than you. You were still in nappies when ..... never mind.
As for waiting until October for the consumer law to be instated. Not quite right. The Section 61 of that law will be in effect on April 24 the rest in October.
Section 61 is enough to show MTN what their IQ is with your middle finger.

Topup structure would not allow for a bill limit as one is not needed, when the airtime is used up client cannot make calls.

"You were still in nappies when ..... never mind." - No, go ahead and finish your statement, im a big boy and i can handle whatever abuse you throw at me, although its uncalled for considering your matter and the one currently being discussed is as far as chalk is from cheese. My understanding is that you troll this forum in order to incite people against this company and i have mention of this to the moderators in this forum to no avail, whilst you have every right to be upset i question what you stand to gain in waking a sleeping giant? I say these words as a consumer and fellow forumite, same as you, i have 3 contracts. I help where i can on this site but some of you are beyond my assistance and for that im really sorry.
With regards to your knowledge of the law, thats great man, i stuck to engineering, found it pays better, go figure.
 
I have no probs with you, Snakepit. You work for MTN and therefor have to defend MTN.
