.Durban - They're known as the couple who carry guns on their laps while travelling - and have a plan of action for every traffic light in case the bad guys pounce.

So when Morgan and Yuvette Parmasiven saw four strangers pull up outside their Chatsworth home in a white car, they were ready.

Morgan warned them to leave and fired a shot in the ground, which sent them racing away.

Next thing, the father-of-three was arrested and now faces four counts of attempted murder, while an angry community has lashed out at police.

It turned out the four strangers were undercover policemen, deployed to Chatsworth after a spate of violent crime that culminated in the recent shooting death of 9-year-old Shallcross girl Sadia Sukhraj in a hijacking.

The Parmasivens and other residents claim the plain-clothes policemen returned and fired at the family, then ransacked their home.

Discharging your weapon without sufficient cause can carry a heft penalty.
Based on what's presented in this article alone, it sounds like he didn't have sufficient reason to discharge the weapon.
 
Based on the article it sounds like the police were in the wrong. Hope they get the book thrown at them.

Unless, by "pull up outside their Chatsworth home in a white car", they mean drove through their closed main gate and come screeching up to the front door. Otherwise I tend to agree.

Thats pretty much what the article says - says that the white car pulled up into their driveway, the owners told them to leave, they wouldn't..

If the article is accurate, the cops should have pumped their combined magazines into his skull. People with guns a small pipis are a cancer to society. Law enforcement officials have a mandate to stop and perhaps investigate if they see something suspicious. You can not just shoot at people just because you do not know them. What a ****ing idiot. Next time it will be quarter past dead for him.

Talking about yourself here I guess? Clearly didn't read the article or are intentionally being an idiot.

He should not have fired, no good reason. Though with the crime that’s been happening in that area of late, it's understandable the tension and fear he felt.
The cops did a whole host of things wrong, including firing blindly at the house. Something seriously dodgy about these cops action. Speeding off and then coming back and opening fire. They should all be charged it attempted murder. They, the cops, should all be charged it attempted murder.
 
I don't know, someone pulls into my drive way and refuses to leave will also get shot at. It's the society we live in.

Yah, I don't think he will have a difficult time convincing a magistrate, according to the article he clearly fired a warning shot into the ground and rightly feared with four unknowns in his driveway after being civil.

Anyone got a piece of the firearm act that allows/stipulates a warning shot? It seems he acted correctly: verbally warn, discharge a warning away from the people after being ignored.

Are warning shots allowed? I thought the rule is, is you draw a fire arm, it is ONLY when you want to kill?

Multiple articles seem to state yes and I know from others that a warning shot is to be fired into the ground as you are responsible for the result of that bullet when it leaves the firearm and that is the safest course of action. And to shoot only to kill is a fallacy, the law is very clear that the use of force MUST be in accordance to the force being used against you and a shooting is supposed to de-escalate. ie: you can't shoot someone who slaps you who is weaker than you, you could wound someone in the leg if they are a massive person and you are not and they are hitting you. You also can't shoot anyone UNLESS you are actively threatened, ie: burglar in your house cannot be shot unless they attack you. You can fire a warning shot in your house though to ensure they leave, if they choose not to, then quite possibly a further shooting may be justified as they intend harm.

A good motto for any firearm owner though is to ONLY draw the weapon if it is intended to be used. Otherwise it should remain holstered and safed.
