Cops off the hook in bizarre rape payout case

Cape Town – A verdict of not guilty and discharged on Tuesday, was music to the ears of two greatly relieved police officials, who landed in trouble for innocently trying to assist a rape victim who wished to withdraw a rape charge.

The bizarre case was placed before magistrate Constance Nziweni, in the Parow Regional Court, and resulted from an agreement between two families – the rape victim’s parents and the parents of the alleged rapist – to withdraw the rape charge in return for R20 000.

The curious meeting between the two families was part of African customs and traditions – and was similar to modern day mediation – the defence team, attorney Khanyisa Lingani and advocate Sabelo Noxaka, told the court.

“The time has come to consider African jurisprudence, as an alternative form of jurisprudence that has survived the course of time,” Lingani said. He said the meeting that took place was a practice that was approved by African communities.

Before the court were Portia Gqotso, and Manenberg police officials Sanele Mapipa and Zwelithini Gwele.

The court heard that the rape victim considered herself bound by the agreement reached by her elders, which involved the payment to her family of R20 000.

If and only if all parties involved are satisfied with the mediation AND it is allowed by our legal system, then I don't see the problem. Its a culture thing. Does seem however that the victim here seems to be forced into this?

I dunno. Child brides as young as 10 being sold off to older men is also a cultural practice in some parts. Not sure Im in favor of it just because they are...
 
That's a pretty fscked up culture. The woman should go ahead and press new charges, what the elders did is none of her concern.

Probably not, but other cultures have a whole different moral code. What is normal to them is repulsive to you, etc etc.

BS, there's no such a thing as African culture. In all the cultres in SA, there's none that says a rape victim can be paid off. They must just say the current justice system does nothing for the victim, just punishes the perpetrator. Maybe they think it would be best if he paid a fine which take care of medical bills & trauma counselling etc
 
Finally I've found the answer to what African dispute resloution is from a few days ago.

Yes, except the rest of us are still living with a rapist in our midst.

Where's the equality in this?

So if you are black and rape you can sort it out over a few drinks with cash exchanging hands, if you're white you must go to court and face the music.

I never mentioned race and my comment was basically exclusive of race and assumed it would apply to any race. We are all African right?

Never mind race. If you're poor you go to jail. If you've got a few bucks, do what you like and pay off the victims if you get caught.
