Cops off the hook in bizarre rape payout case

Where's the equality in this?

So if you are black and rape you can sort it out over a few drinks with cash exchanging hands, if you're white you must go to court and face the music.

Despite my distaste for what happened, am not sure you will ever be able to get a rape conviction without the co-operation of the victim - if the victim doesn't want to press charges there is no way they would make a rape charge stick.

I wonder how much pressure was placed on the victim by her elders to accept this...
 
Never mind race. If you're poor you go to jail. If you've got a few bucks, do what you like and pay off the victims if you get caught.

You think justice for poor and rich is the same? No offense man, really not trying to be facetious, but what world do you live in? Yes, the rich get better "justice" than the poor. That is the way of the world. Do I like it? Of course not. But its the same with medical care. The poor get crap, and the rich get better. Messed up, but reality.
 
This could be extended to murder as well. We could purchase pre-paid murder tokens and the proceeds go the the family of the victim. Maybe a discount for every 10 rape or murder tokens purchased.

Could they accept in advance? Would make it open to abuse.
 
This is just too wide open.

Show me a system that isn't too wide open? People kill each other for insurance money. People hurt themselves purposefully to sue for damages. I am a vengeful person and don't agree with this system. But if others feel satisfied with this level and system of justice, then who I am to judge? It is after all about money. Which is the cornerstone of justice. Bail gets set using a monetary value. Lawyers get paid in money.

If and only if all parties involved are satisfied with the mediation AND it is allowed by our legal system, then I don't see the problem. Its a culture thing. Does seem however that the victim here seems to be forced into this?

Well, if the amount paid was very high and the accused really hurt financially after the payment, how does it encourage rape? Surely a hooker is cheaper? Just playing devil's advocate.

I wouldn't say encourages. At R20k it'd be cheaper to go to a hooker. It does lessen the seriousness of the crime though. You could quite easily have a accident that costs you more than R20k. It's like a bit of an inconvenience rather than the consequences of a terrible act perpetrated against another human being. "Oops. Wish I hadn't raped that chick. It's going to seriously **** up my December holiday".

If she ends up pregnant..or contracts HIV,Hep B,C ext ext... does the accused have to pay a bigger "fine" for raping her ?or how does this circus work ?

Dude, getting a divorce can really hurt financially. You're relegating rape to the level of just another poor life decision rather than a horrible abuse of another human being.

My point is that being hurt financially is a consequence of making poor life decisions. If being hurt financially becomes the consequence of rape you are relegating rape to the level of just another poor life decision rather than a terrible crime that harms another deeply.

But, I think I've just more or less repeated myself. Don't know how else to put it.
