Hello I have potential client that bought a gtx 760 from computer mania yesterday.

I feel he was ripped of ,because he paid R4600 for it.

He did open the card and use it in his pc.

I told him to take it back and buy a gtx 970 form me which he was happy to do after he saw how much faster it is.

Computer mania did not want to take the card back even know it is less than 7 days old ,they just told him they don't do returns on graphics cards lol

By law computer mania should refund him right ? Because if someone would return a graphics card to me I would also need to refund him ,because it is less than 7 days.

Not sure about the law but your client purchased something, never did his homework, was never forced into the purchase, used the product and now biatches about a product that has nothing wrong with it?

There's nothing wrong with the card, tell him to stop whining and he has absolutely no legal recourse whatsoever. Computer Mania should tell him to p1$$ off.

Not at all ,actually feel bad for the guy ,because I was like him back in the days.

He now wants to give computer mania another 2k so he can get a gtx 970 from them.

They told him he can exchange it for a better gpu with cash.

Or the guy ordered another brand 760 on his own request which may had cost more. In the case that he paid more than advertised, he is well within his rights to claim his cash back.

Legal assistance required here: IIRC, buyer’s remorse can be covered by the seller’s own policy in compliance with the CPA to warrant a non-cash replacement.
 
The CPA covers faulty items, not buyers remorse.
He asked for it, paid for it, used it, now wants to return it. They are not obliged to take it back.

It would now be a used item.

If they take it back and let him buy a bigger one, it was done at their own discretion.

That sucks. So they are willing to accept the card back, but only if he spends more with them.
 
Which is perfectly acceptable business practice.... They are not legally obliged to take the card back at all...

Indeed.

Buyers remorse is not covered by CPA. The person should have either researched first, or approached the OP, before laying out the cash.
