Hi. I have a situation and need some advice please.
I borrowed my backup phone to a "friend" but now he does not want to give it back. I have no witness that heard I told him I am borrowing the phone to him.
I have all the documents proving ownership.
To blacklist the phone I need a case number from the police, but according to them it is not stolen so I can not open a case.
I need help please, I am on sassa and can not afford a civil case, cause that is what the police said I must do

Police is useless with cases like these ... you can write that phone off.

They have boxes full of paperwork with cases like these where people freely "gave" something to someone and never got it back.

Open a case and tell the police he stole it. Don't mention that you lent the phone to him.

Let a magistrate decide his fate.

You're the plaintiff so don't need legal representation. He will need a lawyer, which will set him back more than the phone is worth.

Make 101% sure you have the time and date correct. You don't want to get that wrong in case he has an alibi that some other witness can corroborate.

The fact that you're in a wheelchair will count as an aggregating factor should he be found guilty.
