Was called by www.icom-it.co.za NDC on several occassions requesting money for a loan that I paid off in full 3.5 years ago (As far as I can recollect).

They started a few months back and each time they phone I tell them I am not paying a cent without proof of the loan and documentation associated with it.

This usually chases them away and invariably they call back months later asking the same thing.

Anyway again they phoned (about a week ago) - and I asked the usual - proof/docs etc.

This time they sent me a doc, only stating amounts added to original (alleged fee) - coming up to an additional R700

So sent them the following:

This is not a statement from the ***** group these are the Fees from the collection agency - until I see proof this money is owing (Which I have asked for on numerous occasions and has never been sent to me) this account will be outstanding.

I am requesting proof of initiation of loan, a document containing the account the money was paid into, and a document containing payments made (by me) into the aforementioned loan.

So what do? Pay this mysterious amount???? Leave it????

Its been discussed a few times.

As a non lawyer I would request a settlement letter from the original company and send it to them.

Every time they phone you they charge you for it, that's why they keep phoning.

I get at least two calls from DMI attorneys for a Telkom bill I paid yonks ago, in fact my line's been disconnected for at least two years.

Them: "Hi, this is blablabla from DMI attorneys"
Me: "Voetsek!" and hang up

They don't call back for a week or so then.

There really should be a law against these people!!!

This.

Had an issue at the end of last year with a law firm contacting me on behalf of Telkom requesting settlement of an account which was closed and paid in full about 2 years ago.

Kept claiming I need to pay the money into their account but could provide no statements showing where I owed money. According to Telkom when I made contact there was nothing owed...

Curiouser and curiouser...

Lawyers fees, i owe telkom 30 cents and the fees are R160 :erm:

Yeah its crazy - phned debt collector now - the amount has suddenly increased (there are apparently 2 seperate amounts for the same company)

Asked them why -

Response: I don't know

Ask them for original documentation

Response: I don't know

Phoned original institute where debt apparently originates: I don't know-

Meanwhile the amount grows by R150 pm

So do I just pay the R1200 and let them win :'(

No dont pay a cent. If you last paid more than 3 years ago. And even if you did still owe money the debt has prescribed.

Don't pay a cent until they can prove that you really owed the money.

I'm worried they randomly blacklist me-

And if it turns out I did owe the original amout after 2 years - they'll add on like R2000 worth of additional costs

Stop the phone calls and do everything in writing.

See THIS thread.

Also have a look HERE regarding prescription.

... "this account will be outstanding"

Bad choice of words, Dude. They can take that as an acknowledgement from you that you owe money.
You should have clearly stated that you dispute the amount and deny that you owe anything.

Ignore it until they send you a proper statement detailing the full details of the loan i.e. loan amount, fees, payments, interest etc..

Most of these debt collection agencies buy 'old' debt from companies at a big discount after which they start hounding the people. A large number of these debts are already prescribed i.e. has expired according to law and can thus no longer be legally collected on.

Most people are unaware of this and pay the amounts requested. The debt collection agencies laugh all the way to the bank. I know of one firm that buys most of its debt at a discount of 70%. That means that they make 70% profit if they are able to collect all outstanding amounts, and that excludes all the 'charges' they add.

This.

Make sure to send another email stating you do not owe any money and do not accept any liability for claimed amounts unless they or their client can forward you the correct, corresponding docs.

I see what you guys are getting at but I used the term "This account will be outstanding" - stating the account as its own entity.
I could understand "my account" as being admission of guilt.

eg: this dog pooped on the sidewalk - doesn't mean I own aforementioned dog :P

Anyway thanks for advice I will send an additional letter stating I denying owing anything -
