Durban doctor's murder: Woman arrested will not face charges for now

A Durban woman arrested in connection with the death of orthopaedic surgeon Dr Melvin Naidu acted in self-defence, her lawyer said on Monday.


The woman, 31, who cannot be named because she has not appeared in court yet, did not face any charges or stand before a magistrate after the State chose to investigate the case further.

Her lawyer, Ravindra Maniklall, said she had claimed self-defence.

"She claims she was attacked, and she acted in self-defence. We made confidential representations in terms of the actual incident that occurred between the parties."


He added: "The State is not enrolling the case. They don't believe they have a sufficient case to prosecute at this point in time."

Maniklall said the decision not to prosecute her could, however, be overturned.

Oh? I haven't heard that, just heard she was not being charged.

It seems like this guy was as dodgy as his brother in law.
Apparently not being charged yet because they have to investigate.
 
So you are found with the deceased victim. Your lawyer admits you killed him, claims it was self-defence. You get to go home while they investigate. This is routine procedure?
 
Woman held for doctor’s murder and then released 'was engaged to politician'

Durban - The woman arrested in connection with the murder of a prominent Durban orthopaedic surgeon was set free in the Durban Magistrate’s Court on Tuesday, a few hours after the doctor’s funeral.
The State said there was insufficient evidence to charge the woman.

The Daily News learnt that the businesswoman had previously been in a long relationship with another businessman who is also a politician, and the couple were engaged at one point.

She had spent four nights in custody before being released yesterday, without appearing in court.


Her lawyer, Ravindra Maniklall, said the woman had acted in self-defence.


Dr Melvin Naidu, 51, was heard screaming before he staggered from a plush room at the Capital Pearls hotel in uMhlanga and collapsed on Thursday.


It is believed that Naidu had booked into the hotel with the woman.


She was the only other person in the hotel room with him at the time.


Her family and friends arrived in court early yesterday in anticipation of her first appearance after she was arrested at the murder scene on Thursday, but her name was not placed on the court roll.


They were seen speaking to Maniklall and sat in court from the morning until after lunch, when Magistrate Vanitha Armu told them the State had decided not to prosecute her.
