Hello everyone:)
I am checking up on somethings with the ECT. I want to find out if the old ECT of 2002 has been changed in the meantime? I know there is a new ECA that has been signed into law in this year - is it the same or something completely different? I am interested in the whole .co.za domain thing the goverment wanted to control.

Hi

common confusion :)

the Electronic Communications and Transactions Act No 25 of 2002 came in to force in June 2002 and it remains in force without having been amended (although there are some proposals). The ECT Act is a broad piece of legislation dealing with legal issues around data - most importantly it broadens the legal definition of "writing" to include data. It also deals with authentication, cryptography, limitation of liability of ISPs, consumer protection, privacy and cybercrimes - amongst others. Go to http://www.internet.org.za/ for links to this Act and regulations

The Electronic Communications Act No 36 of 2005 is something completely different - this came into force on 19 July 2006 and deals specifically with telecommunications and broadcasting and the convergence between these at the industry, technology and legal levels. It replaces the 1996 Telecommunications Act and most of the old broadcasting legislation. Copy from www.icasa.org.za (see link to ECA documents at the bottom right of the home page)

so we have an ECT Act and an ECA which are completely seperate
