“We don’t believe we are getting a fair hearing because of a lack of neutrality on behalf of the chairwoman,” said Telkom spokesman Xolisa Vapi. “It would appear that the hearings have a pre-determined outcome…. The chairwoman is taking an aggressive line towards Telkom. We welcome robust discussion, but it must be fair.”

ROFL !!! Telkom talking about fairness! How typical is that BWHAHAHAH!!!!!!! :D :D :D

"The chairwoman is taking an aggressive line towards Telkom." - ICASA is there to protect the public. Grrrrrr. First time i've heard anybody complain about somebody doing their job effectively.
Ok Ok - I'll stop.

We could have picked up a phone, and called a technical person, but nooo noooo.

You must be joking. Telkom staff are not permited to use the phone, its too expensive, that's why the tchnicians have to tap into your line to call the office

Telkom will say just about anything to protect its Monopolistic Profits.
We welcome robust discussion, but it must be fair
This remark does not surprise me.
But, were they being serious or just trying to create some or other legal loophole?

The truth is out and they don’t like to hear it.
One wonders when one looks at your account with a deficit balance if that is fair?

Telkom gaan vlieg man, you guys are the most unfair blaarie company in South Africa.

Don't start playing the victim, it makes you look even more pathetic.

If ICASA do make substantial recommendations and IVY does not act on it, the crap will hit the fan.

After Mbeki's commitment to get access to nation as well as some of the statements made by the Telecoms Dept, if this proves another waste of time, then we should just get more militant in our protests.

they are laying the groundwork for a legal challenge where they can go to court/another forum and ask for a review of the decision of ICASA on the basis of bias...they would need to be seen to have protested at the time [not sure if they stated this at the hearings as well]

the purpose would not be to win but to delay the inevitable as much as possible

Should any legal representations be made on the grounds of alleged bias, it can only be summarily dismissed as spurious and vexatious, purely given the fact that they were accorded the right to respond, at which time issues of 'fairness' should have been (were?) addressed by them...

they probably would be dismissed as such at the end of the day but the process of going through the motions to arrive at a point where a court is saying stop talking BS and get on with it would delay the implementation of any ICASA recommendations for quite some time (getting ahead of ourselves there)...their bleating bears all the hallmarks of a strategy from their legal advisors

"its not fair" = we have had it our way for so long its not fair to start talking about things being fair

Question : Is ICASA legally obliged to communicate its recommendations to the general public when submitting same to the DOC? or will their finding be kept private?

All those members of the public who attended the hearings were asked to sign an attendance register. I was contacted by ICASA yesterday and asked for an e-mail address so that they can communicate with me....I would presume they will e-mail the findings to us, and if this is the aces I will post it on the forum.
