So anyhow as per previosu threads been looking for a car for my daughter, but haven't found one yet.
so in the mean time she been using my wifes car to get to varsity and back.
She had an accident a few weeks back and now the insurance dont want to pay, they humming an bleeting that suddenly she has become the regular driver, what bs.

Now my wrecked car sitting at some yard, who knows where, gonna cost me a fortune to fix, if its even fixable.

As everyone has said as long as she was fine and not badly hurt, but not good times.
 
well why did you tell the insurance company that she is a regular driver ? you should have told them that it was an emergency and that she had to drive her self. but its too late now. I feel you pain, my bicycle got stolen out of the underground parking area of my flat buidling and the insurance company said, well you dont have an out and about insurance, so we are not able to pay out. They always make up some excuses to not pay for anything :(
 
I did a bit of research into this awhile back when I wrote my car off. I was looking into how much I could expect my insurance to pay back. I found a website with a whole lot of cases that the client (been you) asked for a judgement from the Insurance Ombudsman regarding claims that had been rejected. There was a case exactly like yours were the Ombudsman ruled in favour of the claiment (sp) I don't know your exact circumstances or what is specified in your policy but I would seriously send your claim through to them. I can't remember the website will try and see if I can find it though.
 
tdm : Insurance companies have this habit of twisting things..... I'm guessing furnic didn't say she was the regular driver at all...

furnic : I would fight with them and threaten to take them to the insurance ombudsman if they don't play ball... How long have you been insured with them? and who are they anyway?
 
no-one said she is the regular driver, they just decided.
yeh will go to ombusman but that just drags on and in the mean time so many transport problems.
damn, but shes ok, just bruised, and writing exams, and upset.
frig, if you work for an insurance company, i hate you all, you the scum of the human race.
 
well if you have never said that, i would just start fighting for your rights, phone the insurance company and tell them you are going to drag them to court if they dont pay out, or the ombudsman, this just sucks :(
 
Is there a way to sue them? I dont like insurance companies, im sure the underwriters and their legal policies are unbreakable, but is there a way?
 
Take the contract you signed to a top lawyer and ask for assistance.

Cheapest route - ombudsman. Very effective in most cases too. Takes a bit of time, but not as long as one might think.

You pay a fortune away to them and when push comes to shove they'l make all kinds of reasons to either pay you nothing or as little as possible... not sure who is worse... SARS or insurance companies :mad:

Insurance definately!!! I treat the assesors like crap every chance I get... the last guy came in gave all his stories and asked for a glass of Coke, I gave him water and I had the Coke!:p Never trust them, make them wait outside your house and park their cars in the street!
 
a friend on mine paid 40% of his claim. he had an accident.

Hamford Insurance, they are a no no. they are cheap, but there has been alot of horror stories.

I am using them. I wouldn't recommend them to any one. From Dec, I won't be using them. I was stupid and lazy to change to another company.

Some of their additional stuff are like:
1. If you are under 25, you pay additional R2500 on top of your excess
2. If you have an accident between 10:00 PM and 06:00 AM - another R2500
3. If it's a single collision accident - another R2500
4. If you claim within 90 days of your policy inception, another R2500
5. If your driver license is less than 2 yrs, another R2500
etc
You might end up paying more than the cost of repairing the damn car. :p

My Wife, Mother and Dad is on as drivers of my Bakkie.



My wife is my broker :p

Eish i'm not married:) and under 25:(so these fools(ins companies) are taking full advantage of this:(
