Flyboy, I'm glad you are getting a response. I tried a different tack, pointing out the over-use of "Enter the Broadband Zone" on everything from the modem box to the dial-up software.

The problem with the ASA's response is that it is just too damn slow. They have had more than four weeks to address the issue, and have yet to make a decision. Can we lobby the ISPA to revert quickly? This delay is only good for Sentech. Effectively, a free pass on misleading advertising for a month. The ASA has no real teeth, they can only recommend that an ad is withdrawn, there are no sanctions in terms of refunding consumers etc... The only real advantage of an ASA ruling for us, as Sentech dupes, is that it is more publicity for our cause and more leverage against Sentech.

I emailed Ant Brooks last night and he replied saying he has not received anything (via email) from ASA.
He says usually ASA faxes them stuff so he will check today. I also forwarded him the original complaint I lodged and told him if he wants any feedback at all or to even see the speeds he must let me know.

The longer it takes the worse off Sentech will be, IMHO. If the complaint is finalised after they have fixed their problems, they could still be required to compensate users for the time the service was substandard.

If the FIXED service is below 128k and the ASA rules in favour of scrapping their "Enter the Sentech Broadband Zone" slogan then I think they'll be screwed, because then all the contracts signed thus far will be signed under false pretences.

Even if they are only forced to CLARIFY what they mean by "shared 128k" then the contracts could be reviewable, for the same reason. So basically the ASA has to do a complete whitewash of the issue for Sentech to not lose out.

Donn, actually the ASA can only recommend changes to the advertising i.e. withdrawal, change etc. They can also recommend a public apology in the same media as the ad flighted. As for compensation, they have no mandate.

Arf,

A representative from ISPA did inform me yesterday they were emailed a lot of information from ASA - my complaint and Sentech feedback and all the ads I emailed too.

He is going through it so Ill give him a day or two then ask him for his personal opinion on this whole matter

Please inform the ASA that Sentech have now officially started capping, yet another violation of their advertised service benefits.
