She was on your right.. so you had just overtaken someone else on their left? if that's the case you are at fault.

The damage was to the left of OPs car ;)

The bigger question here should be, why was the OP reversing down the highway :P
 
question ... if both drivers turn at the exact same time for the middle lane on from the left lane and one from the right lane who's right of way is it ?

the person who is further ahead

if both cars are exactly parallel to each other it will be treated as both at fault (yes, there can be accidents where both are guilty).

Where did you get that from? :confused:

If you read the OP's first post you would have seen that both parties changed into the same lane.

I still say that I was like 70% IN the lane and I can't understand how her on the right, couldn't see a big orange Volvo next to her - but I guess besides the point.

It was an accident, that's why it's called an accident and not a collision because a accident means "no one was at fault" whereas a collision means "someone was at fault" *grin*

It's part of the reason why EMS in this country calls car accidents "Motor Vehicle Accidents" (MVA) because no one ever is at fault but in other countries it's called "Motor Vehicle Collisions" (MVC) because the reality is, someone is at fault.

Accidents just dont happen. There is a cause for all accidents, something broke , someone was not paying attention, road conditions , weather, equipement, the list is endless,but, there will be a factor causing the accident.

In other words my car was on her driver side and I can't quite get why she didn't see.

I was indicating and when I got out and told her, all she said was 'so was I ...' - I couldn't see if she was or wasn't.

Cars were pretty much exactly parallel - the front wheels touched each other graunching mine and ripping hers to pieces (plastic)

And I reported it to both the police (what a mission ... so inefficient!) and my insurance.

Whether it is R2k or R3k - it's not worth going through insurance. I'll fux my own car and she can do the same. Anyhow - I haven't heard from her or her husband since the incident to discuss anything

it has been weekend. You might only hear from her/insurer in the coming week

As you have now reported to your insurer, remember to redirect any correspondence from her/her broker/her lawyer/her insurer to your insurance co.
Make sure you say as little as possible if any of them do call you.
Give them your claim number and the name and tel number of your claims person at your insurer. Let them handle on your behalf.
 
so moral of the story .... drive ahead of the pack and keep no one near you :p
 
He contacted me today .... sounds like they haven't gone to a police station or anything as yet.

He seemed to try a thinly veiled blackmail attempt by saying that 'he doesn't want to be kids about this and rather settle like gentleman without police etc ... as the lady in the car with the driver is a witness to me being guilty'

Was happy with 50% oh her dent if I paid the rest - until I mentioned that my car is damaged too so we have to add that into the calculation and then do the 50%. Said he wants to see the damage ... so we'll wait until he comes forward again

Sounds as if they do not have insurance, you have to stop right now. Give him the details of your claim and let them handle it from there. Too easy to say something that can be taken as admitting that it was your fault and with their witness you need to lawyer up.

I'm not claiming ; I'm just repairing myself as I don't see the point in claiming the R2-3k (I think) and will just take the knock on the chin. They should, IMO, do the same.

Surely they'd be silly to open anything for a few grand even with a witness?
Btw - what if I'm right and they never did an accident report?
 
Yeah, do not talk to the person anymore Dolby.

Do not offer to pay anything towards their repair, as that is admitting fault. Refer them to your insurance company if you have notified them of the accident.

Keep your AR Number with you. Sounds very much like they don't have insurance, and if they haven't been to the police yet, they've already broken the law which the insurance company won't be happy about.
 
They have 24 hours to report the accident to the police according to the Road Traffic Act (I think thats the Act, I could be wrong)
