Fine for 'not moving over' squashed

What a pisspoor judgement.
The cop did not abuse his power. The motorist broke the law.
 
Lame! That judge is probably guilty of it himself! This is one of the most dangerous acts on the road that either go unnoticed or unpunished.

The cops broke the law by going over the speed limit.

They are two entirely different cases that need to be dealt with separately.

The man should be fined for not keeping left. The cops should be disciplined for breaking the speed limit without their blue lights on.
 
Errr, if the cops put their blue lights on then the baddies are gonna know that they're after them. Back when I was in the force, that was the first thing they taught us. Element of surprise.
 
You only have to move over to the left if it is safe to do so. For me it isn't really an option because the left lane is usually in bad condition due to heavy vehicles, poor construction and maintenance, and the heat.

Rather be a danger to those around you and catch the crook?
 
You're only a danger if they're stubborn and refuse to move, in which case we were taught to ram you off the road.

Read of many people getting wiped by cops at red robots etc.

I'd rather you didn't kill my family trying to catch a crook, thank you.

Sounds like you are looking for excuses for not having to move over... and those are pretty weak excuses. :)
 
No Look it's ridiculous to give a fine for not moving over especially if you are doing 120Km/h.

On the other hand, if there is some chop/idiot/my appointment is more important than yours/let me speed/GTFOTR person behind you, let them pass... It is the courteous thing to do.

No it's not ridiculous. It's the flipping law. IT IS SPECIFICALLY STATED IN THE ROAD TRAFFIC ACT.

5) Where the driver of a motor vehicle which is being driven in the right-hand traffic lane or in the traffic lane furthest to the right on a freeway (hereinafter referred to as the first vehicle) becomes aware that the driver of another motor vehicle (hereinafter referred to as the second vehicle) intends to overtake the first vehicle, the driver of the first vehicle shall steer that vehicle to a lane to the left of the one in which he or she is driving, without endangering himself or herself or other traffic or property on the freeway, and shall not accelerate the speed of his or her vehicle until the second vehicle has passed.

-- Was he Aware? The report says the cop flashed him.. did he see it, I don't know neither do you?
If not, then he was not aware!!one!11!

-- Again, was it safe? Was there another car flying up on the left hand lane? Was there even slower moving traffic? Motorbikes lane splitting?? So was it safe, I don't know neither do you?!!one!11!



EDIT: A Judge has ruled on this matter, as well the motorist was in the right and the cop in the wrong. I'm sure the judge knows the law and case law better than you or I. So it's already been settled, no reason arguing actually.
