Fine for 'not moving over' squashed

Sounds like you are looking for excuses for not having to move over... and those are pretty weak excuses. :)

Nah- I generally do move over but I also drive in the fast lane most of the time for the very reason that the left hand lane suxxors worse than the right lane.

But it is true - you do not have to move over unless it is safe to do so. Whether the magistrate will see it the same way is another story.
 
You only have to move over to the left if it is safe to do so. For me it isn't really an option because the left lane is usually in bad condition due to heavy vehicles, poor construction and maintenance, and the heat.

Saying that you refuse to drive in the left because of maintenance is a poor excuse. Maybe less than 5% of the entire highway network is in a bad condition.

Believe it or not, Highways in South Africa are generally very well maintained.

I never said that I refuse to drive in the left lane. I said that I don't drive in the left lane as a matter of course. And if there is a problem with the road it is more likely to be in the left lane. Knowing that but not exactly where the problems are means that I would have a greater chance of encountering them if I sat in the left lane. And seeing as I have already gone through the trauma of a double tyre burst due to crappy roads in South Africa i will do it my way.
 
If the facts found had been that it was not safe for the motorist to move over, the judge would have dismissed the charge for that reason.

Instead he dismissed the charge for the policeman abusing his powers, which is a bull**** judgement and shows the judge did not apply the law correctly.

I would read that judgement as: The motorist was justified to stay in the right hand lane (due to safety or whatever reason), and therfor the cop had no legal reason to pull him over and fine him.
