'Tired' Mcebo Dlamini pleads guilty but avoids jail time

Fees Must Fall activist Mcebo Dlamini on Monday pleaded guilty in his criminal case, but has avoided jail time.

He was given a suspended sentence following his plea and a sentencing agreement.

Dlamini's attorney Aviwe Yakopi told TimesLIVE that his client pleaded guilty to a charge of public violence and of unlawfully and intentionally staying in SA. The plea came a day before his trial was set to continue.

The Johannesburg Magistrate’s Court sentenced Dlamini to two years, wholly suspended for five years, for public violence. He was also given six months' imprisonment, again wholly suspended for five years, for unlawfully staying in the country.

Dlamini’s matter was handled by advocate Dali Mpofu. It has gone on for four years with various postponements.

It started peacefully but became violent, says Mcebo Dlamini as he pleads guilty

What started as a legitimate protest escalated into an act of public violence, which disrupted academic activities of students and rendered his citizenship illegal.

This was the admission of Fees Must Fall activist Mcebo Dlamini, who stated the sequence of events while pleading guilty to a charge of public violence and unlawfully and intentionally staying in SA.

By pleading guilty he avoided jail time, with four of the six charges he was facing falling away.

“Acting in concert with my co-perpetrators, during the said protest, we unlawfully assembled with a common intent to forcibly disturb the public peace and invade the rights of other persons by unlawfully and intentionally disrupting the academic activities of the University of the Witwatersrand,” Dlamini said as part of his admission of guilt, which the NPA made public on Monday evening.

Johannesburg - #FeesMustFall student activist Mcebo Dlamini has now got a criminal record that puts an end to his legal career ambitions.


The law graduate and former University of Witwatersrand SRC president was on Monday found guilty of public violence and slapped with a suspended sentence of two years and six months’ imprisonment.


He will, however, only do prison time if he is found guilty of a similar offence in the next five years.


Dlamini made the announcement of both his conviction and sentencing on social media. “Today marked the end of my legal career. The court found me guilty of public violence, thus (sentencing) me to two years and six months (conditionally) suspended sentence for five years.

Shame poor fellow. I think the president should, not only pardon, but also expunge his record. He was fighting for a just cause.
 
Not a sentence at all. He should be behind bars, as someone's play toy.
