Gareth Cliff beats M-Net

Nicholls said M-Net had failed to prove that the Idols brand would suffer if Cliff was temporarily reinstated.
Cliff’s image however would be affected, said Nicholls.

“A defamation action in due course or even a declaration of the unconstitutionality of M-Net’s termination of Cliff’s contract will not address the reputational damage that Cliff is suffering at present,” she said.

At the time of his dismissal, M-Net said it did not believe Cliff was a racist, “but his response showed a lack of empathy for our history and it is important to differentiate between freedom of speech and hate speech”.

Firstly, MNet is confused(or their legal representative is).

Secondly, they have proved that they don't understand the difference, and have ironically committed libel against Cliff.

That depends. Income can also be derived from sponsorships or endorsements. MNet's actions would have hurt his career regardless of him being reinstated. The saying you can't unring a bell comes to mind. If they keep him they would just settle for a much lesser amount. If they don't keep him they may settle for the full amount to just avoid hurting their own reputation and that of the show further.

I am no Cliff fan, i find him Arrogant and full of himself, however, i am glad he won.

Its really tiring to constantly hear the race card being played, whenever a white person disagrees with anything black in the country they get labeled a racist, the government plays the race card on a daily basis so I guess they are setting the great example everyone else just follows.


South Africa will NEVER heal until Race is completely removed from the picture and all the laws. This is something that the ANC does not understand and what many South Africans do not understand. You can either have "apartheid / reverse apartheid" or Unity, but you cannot have both, and there is no unity and never has been, the country was divided before 1994 and its still divided... You CANNOT have unity or equality when laws favour one race over another, it doesnt matter if it is to rectify past mistakes or whatever the reason, the moment a law favours one race equality goes out the window...

And When did we become such pussies that everytime someone calls someone else a name you run have to court or the newspapers... There WILL always be racists on both sides of the border, that will never change, get over it and move on.

I dont see anything changing in the next 10-15 years, Civil war is what this will come down to, and it wont be white against black...

The sad thing.. I agree with you. There is something wrong with South Africa as a society. And the only way to fix it will be brutal and painfull.

I dislike Cliff less than M-net so am glad that he won.
What I find hard to understand is that Trengrove must have known up front that the e-mails would sink M-net but he still went ahead.
 
This is a big win for freedom of speech and things that gets taken out of context for no particular reason but pure politicising. ANCYL can suck balls after this ruling! :p

I've been saying this in just about every other "race thread". (I've given up posting, because it's just so fckning pointless.)

The reality is that the anc cannot afford to give this race thing up. The minute they do, the masses will realize that they (the anc) are the "bad guys" here. That they (the anc) are to blame for their (the people's) current miserable situation.
Once WE, as South Africans, the people of all races, creeds and cultures stand together, THEN and only then we'll be able to move forward. The anc HAS to avoid this by any and all means possible.

That's where their shills, like the ngwe23's of the world, come in to play...to focus on the bullshlt utterings of the Penny Sparrow-nobodies, instead of the REAL issues like education, corruption, service delivery, etc, etc.

There's no way in hell that the anc is ever going to give up power in this country. No way. The only way this will play out is if we actually get a good guy in power (at this stage highly unlikely), through civil war as you said...or it won't at all. I hope I'm wrong...but given their track record in how they handle and deal with things...I just don't see it happening.

EDIT: Anyway...I'll calm down now...it's just hella frustrating.
