How come a replacement unit, I am assuming was new when you received it, has no packaging?

original was 32gb, started bootlooping - sent it back to the usa and huawei replaced it with a new 128gb..no packaging correct.
 
I'm interested but I'm worried about the class action lawsuit against Google regarding the bootloop issues that many of these devices were experiencing once updated to Android Nougat.
Is this device by any chance running Nougat already (Ver 7.1.1) or above?

the previous 32gb version did that the bootloop and i sent the phone back to the usa with a family member.huawei replaced it with this new 128gb silver.its on the latest version of android 7.1.2
my 32gb black one is on the latest 7.1.2 , been using it for over a year and it never had the bootloop issue
