It doesnt matter. The host isnt storing or sharing any copyrighted data - the users are.
 
Yes, but the host is knowingly allowing it. ie they are helping users commit piracy.

Hosting company took some heat and dumped them.

You might as well shut down every ISP in the universe LOL! ISPs typically would have "safe harbour". See also the USA's Online Copyright Infringement Liability Limitation Act and its

"Communications Decency Act (CDA), which states in part that "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider"."
