Having issues at work please help what do i do

Hi ladies and gents

I am having a bit of a problem at work and would like you guys to assist me in what I should do regarding this issue.

Unfortuanlty a huge amount of money has gone missing from the store and the boss is out on a rampage to find out who has stolen this money.

He has sent everyone for a polygraph test without giving anyone notice or anything on paper and from my understanding that if someone goes for a polygraph test that they should be given notice and that they need to get checked out by a doctor for any health problems but none of those where done and I hear it's illegal.

He called each one of us to come with him and took us to a office where a lady was awaiting us.We where then given a piece of paper that we had to sign saying that they have the right to do the polygraph test.No one knew and I though I was going to help me carry boxes when he said I should go with him.

A week later he calls me to the back office and tells me to have a seat.He had the polygraph results.He then told me that everyone that did the polygraph test passed beside me.He now wants me to do another polygraph test and said that if i fail this one he will have me arrested.

The boss has even managed to get my bank statements to check if i have any money that was stolen from him.He never asked any permission to look at my bank statements.I just saw on his pc when he called me to the back office that he had my bankstatements.

Im very unhappy working here at this place.Also on my contract it states that I should be working 45 hours a week which means I get two days off a week but I only get one weekend and the rest is one day a week everyone gets it.We get no overtime pay and it has been going on like this for a while now.

I just don't want to go to ccma or labour law without knowing anything.Thats why Im asking for help and what i should do.

How the hell did he get your bank statement? Have him arrested for identity fraud or something.

How would he have gotten your bank statements?

Also what does the work environment and number of hours suddenly have to do with anything? Sounds more to me like you are trying to justify a reason for having stolen the money.

Instead, they are used to give an indication to someone of which "avenues to pursue". (eliminate the innocent)

You cannot be arrested based on a failed polygraph test.

Its a tricky situation to be. Put simply, if you are innocent then stand your ground. You have nothing to hide.

If you are guilty, well that's another issue all together. You will likely get caught. Simple as that. (you would be surprised what a capable private detective is capable of finding out.) My advice would be to do the right thing.... fess up.

If you are innocent...

Tell your boss to stick the polygraph, they're not admissible in SA law. Then press how they got your bank statements, certainly illegal.

If innocent, you are already guilty in your boss's mind, so go to the ccma and advise your boss of this. Your days are numbered in any case until or if they catch the guilty party.
You don't want to have to face this alone if innocent.

If guilty pay back the money, confess and come to an arrangement.

Unfortunately for you... All your boss needs is one failed polygraph to dismiss you. The labor courts work on the balance of probability and don't need to prove a case "beyond reasonable doubt" like our criminal courts do.
If he can place you at the scene of the missing cash. And has supplementary evidence (like a failed polygraph). That's all he needs to dismiss and the chances that it will be upheld at the ccma are good. Unless there's some procedural issues that the employer is guilty of during the hearing. But to prove that... You need to be awake. Or have a representative that is familiar with the disciplinary process. Consult your union/shop steward if you have one. The fact that he's offering you a second polygraph is actually a plus for you. If you are innocent - it gives you the opportunity to pass the second one. Which will count in your favor.




But seriously... What did you buy with the cash?
