[FALSE] Tim Noakes found guilty of unprofessional conduct - HPCSA

Cape Town - Tim Noakes has been found guilty of unprofessional conduct by the Health Professions Council of South Africa.

"This is after he provided unconventional advice on breastfeeding babies on social media which was not in accordance with the norms and standards of his profession," the HPCSA announced in a media release on Friday afternoon.

Noakes testified and called witnesses in his defence in the case, and these witnesses were cross examined, the HPCSA said.

"The Pro Forma Complainant has now closed its case and there are no further witnesses to be called. The only outstanding issue is that of argument of the matter."

Proceedings have been adjourned until April 4 and 5, 2017.

The Pro Forma Complainant must file its heads of argument by February 1, and Noakes and his legal team will have until February 22 to file their heads of argument. The Pro Forma Complainant will then have until March 15 to file its reply to the heads of argument.

"The matter will then be argued before the Professional Conduct Committee (PCC) on April 4 and 5.

"The PCC will deliberate on the issue and come to a decision between 6 and 7 April."

A judgment on the matter will be issued on Friday, April 21, 2017 by the PCC.

The Health Professions Council of South Africa released a statement earlier in the day saying Noakes had been found guilty.

However Advocate Michael van der Nest told TimesLIVE that it was untrue. "The case is not even completed. Evidence was only completed on Wednesday, written argument will be filed in February. Judgment will only be in April."

In the statement, the HSPCA said both Noakes and the Pro Forma Complainant have until next year to file their heads of argument, which will be argued before the Professional Conduct Committee (PCC) in April.

Noakes was accused of unprofessional conduct after he provided "unconventional advice" on social networks on what breast-fed babies should be given when being weaned.

Noakes made the low-carb diet popular with his book The Real Meal Revolution, claiming the regimen helped prevent diabetes.

The HPCSA was not immediately available to explain why the statement had been released on Friday.
 
Isn't this headline blatant slander?
If this was an official press release by HPCSA, I am sure he would be able to appeal if he is found guilty in the end arguing that the verdict has been predetermined? They may have just made things difficult for themselves on procedural grounds!

And I also think he should then be able to sue on grounds of slander?

Cape Town - There has been no decision over the Health Professions Council of South Africa (HPCSA) complaint against Tim Noakes, contrary to a statement issued by the council on Friday afternoon, his lawyer, Adam Pike told News24.

The council announced in a media statement that Noakes had been found guilty of unprofessional conduct.

"This is after he provided unconventional advice on breastfeeding babies on social media which was not in accordance with the norms and standards of his profession," the HPCSA said.

"It's not true," said an irate Pike.

"It is impossible for them to make a finding," he said. The hearing ended on Wednesday.

He explained that they submit heads of argument early in February and judgment is only expected in April.

The HPCSA was not immediately available to explain why the statement had been released on Friday. None of the three HPCSA contacts mentioned in the release answered their phones.

This calls into the question the objectivity of the entire board.
