This case has no basis, IMO. And I would have sued the security company that controls the complex!!

Does he now want cops to be posted inside his lovely "secure" complex? I live in a complex and I'm quite happy with the security around here. They can be a bit padantic sometimes, but hey thats why we pay them. It seems this dudes court action needs to include the security company as well, hell even the body corporate!
 
Actually it does have a basis. Read the article and see what his complaint is:

"He claimed in court papers the police had a duty in terms of the constitution and Police Act to protect the life, limb and property of each and every person in the country, but had failed in this legal duty and could have prevented the incident.

He accused the minister of failing to comply with his legal duty by employing police officers who could not read and write, not employing enough policemen, not doing visible policing and not maintaining vehicles properly.

"The police services are in general unable and not equipped to fulfil the objectives and functions of the police services as set out in the Constitution and the Police Act."
 
The claim did not disclose on what basis he alleged that the employment of illiterate policeman and failure to provide visible policing and efficient vehicles could give rise to the minister's liability for the damages he suffered.

It sounds all good and dandy, but if he has no evidence on which to base his allegations, then the court case will probably be dismissed. I don't think this guy will get far, but if he does, good may come from it. I hope he wins, but I doubt he will :/
 
I have to agree. I went to the police station a few months ago to report a break in in my car. The police officer behind the counter could hardly spell let alone speak a word of english

Found that as well. Had to write the report myself, and he pretended to read it over before making his cross at the bottom.

Brother had to report a break-in, the police answered the phone with "What!". Nice people skills too.
 
I hope he wins, leading to a flood of claims. Then our esteemed ministry (now almost bankrupt) will have no choice but to increase policing 10 fold; improve overall services; increase policing budget; use army reserves; etc, because it'll be cheaper than a lawsuit a day!

It is the ministers job to make sure there is enough police to protect all fellow south africans. He must make sure there is a policeman on every corner. He must make sure that they have more than 1 active and working patrol car.

He will win this case ;)

As predicted, he lost.

Gerber had not cited any specific police officials in his claim, and simply sued the minister as political head of the police, Poswa said.

Gerber had also relied on "general" statements.

And got stuck with the legal bills of the Minister. People must realise when they sue someone they must have some sort of case otherwise, its just ends up being frivolous and you will regret it in the end.

Pity about the arguments he put forward because I see an interesting case here; while no one can expect the gov. to prevent every single case if a person can prove that the gov. failed to implement what is reasonably expectable in terms of available resources so as to reduce the chances of a crime taking place

There has been a complete breakdown of law and order in South Africa under Charles Nqakula. Clearly there is some point at which one must say the government is indeed responsible.

Since. You know. It's. Their. F-cking. Job.

It seems reasonable to assume (by analysing the stats) that if government was performing its mandate, crime should be less than 20% what it is now, ergo, government can be blamed for over 80% of crimes that occur.

This case may be the wrong way to try hold this grinning smug arrogant prick to account. But HOW then? The time has come where the only recourse left to citizens is violent insurrection. I'm not advocating that, just stating as a matter of fact that there are no other options left.

Peaceful protest eventually gives way after years of frustration to violent outbursts.

Just ask the ANC - they're some of the worlds biggest culprits.
 
Pity he lost but its not surprising. I don't think you could reasonably claim that any crime committed is the fault of the police but if you can prove that the government acted negligently in failing to provide equipment, training and a reasonable standard of policing then they should be held liable. Someone needs to start suing these politicians personally, otherwise they probably don't care if they lose taxpayers money.
