I've uploaded an MP3 of the hearings re local bandwidth. I didnt edit it...too lazy...but Ive shrunk it a fair bit. There is about an hour break for lunch with some backlground gibber. The opening couple of hours are Telkom arguing why the case should not be heard. Its about 60MB in size which is not too bad for caps...

No thanks needed but the support has been most welcome. Im a born trouble maker and its a pleasure to try and bring a company that is holding back and restricting our economy in such a debilitating manner to book (even when not particularily successful). Telkom must come to the party for the good of South Africa and its people and not just for its shareholders. Enough is enough.

60mb is still a bit taxing :), but it'll all in aid of getting rid of these restrictions.
 
My gosh this is heavy going! Only 36 minutes into it and there's still legal waffle crap about dates going on! All we have heard from Tommygun so far is a greeting!

Oh lordy lordy! 103 minutes and the chairman is now asking the Telkom lawyer what the procedure for the hearing is! Bizarre!

Still not down to the real business yet.

LOL! Tommygun told them he did not want to get caught up in "legal rhetoric and filibustering"! That's all it has been so far!

The CCC is in clear contravention of 17 B (a) in that they did NOT do any investigation. How that bunch off stuffed-shirt lawyer types, old, retired, and crusty, could EVER investigate such things is beyond me!

115 minutes and things *might* happen soon.

The only place where the defence case goes prior to the complaint!
Weird.

CCC members are completely clueless technically.

Whew! Very EVIL interpretations by Mr Maritz!

rwenzori it's cool that you've taken such an interest- get to hear first hand the kind of stuff we are up against at these things.

Note the part at t= 80mins when Mr Maritz talks about what Telkom's plan for november.
t= 101 : Telkom being careful with how they accept the jurisdiction of the CCC... "for the purpose of this hearing" and "please don't adjudicate on this matter".

I do mumble a little bit during the adjournment but mostly during the adjournment you're hearing tommygun and alacos, and occasionally Mr Maritz.

Yes TFIANAL was definitely a strong thought I had during the hearing.... desire to maybe oneday do an LLB has been rapidly diminshed!
 
Well I'm at 151 minutes and going to have a break! Certain observations:

1. It is very apparent, and very sad, that joe consumer CANNOT take things to the CCC on his/her ownsome. You HAVE to let a lawyer argue your case - you are dogmeat if you don't. It is sad, in view of things like work disciplinary hearings, and the small claims court, where the lawyers have to stay away. This simply means that unless good people like alacos are with you, you are going to have to pay much $$$, and consequently complaints are just not going to be brought as they should be.

2. Thankfully tommygun articulated his complaint in a strange way, so I figure there is still opportunity to attack Telkom's interpretation of 3.4 on other grounds.

3. Much about the hearing seems procedurally bizarre. The CCC did NOT do a prior investigation as required by the Act. The CCC sought advice from the Telkom lawyer about how the process should take place. The CCC, presumably figuring tommygun to be legally a bit clueless, let the defence happen before any complaint was read. It seemed to be your typical, 'Oh well, let's just rock up and wing it' type process by the CCC members. The Act specifies the CCC has to be just about all legal types, and this is a huge problem, as they are probably just not going to comprehend the technical things, therefore leading to bad decisions. And, oh!, don't they just revel in all the petty legal crap!

4. Telkom hire good lawyers. That chap should have been employed to extract information out of suspected terrorists - after a few hours you just say "OK OK OK ENOUGH! HAVE IT YOUR WAY!". Sheesh! He goes on and on and on and on and on.......

5. The CCC lot should have applied their minds to the whole process long ago, so that there is no need for haggling for an hour whether enough notice was given, and in the right manner. OK they are new to it, but hell, get your act together boys. Set out the whole procedure - NOT hard to do!

At the 151 minute stage it looks ominous. It looks like from some point soon everyone will find their international switched off at the 3GB mark, and then will be billed for local usage. There could be some shocks in some Telkom bills! Pay first, argue later, as usual.
