Web Africa and Dotco have filed a complaint against Telkom SA Ltd in terms of section 53 of the Telecommunications Act with ICASA. The complaint alleges that Telkom's proposed billing adjustments for ADSL from 1 November unfairly prejudice self-authenticating ISPs and unfairly benefit SAIX authenticated ISPs such as TelkomInternet through the imposition of hard capping, price discrimination and liability for bandwidth overruns.
The matter is being dealt with by a senior manager of the complaints handling unit at ICASA who advised today that ICASA has requested Telkom's response to the complaint. In terms of section 53 of the Telecommunications Act, ICASA may direct the holder of a telecommunications licence to refrain from taking any action that is likely to have the effect of unfairly prejudicing a particular group of persons. Web Africa is currently awaiting the resolution of the complaint by ICASA.
