Yeah I know, I am "new thread happy" today but hey.

As we all know, ICASA needs to be chased. I have sent several emails and called ICASA several times asking them to follow up on my complaint. The following is the latest email I just sent:

Hi,

It is now over THREE AND A HALF MONTHS since I lodged a complaint with ICASA about the constitutionality of Telkom's Std Terms and Conditions. ICASA has done nothing but give me a reference number.

I kindly remind ICASA that you have a legal duty to fully consider my complaint. This has, as yet, not been done.

I am now at the stage where I am considering going to court in an effort to force ICASA to perform their duties. I understand that ICASA is severely underfunded, but to take over 3 months to consider a very serious complaint simply cannot be excused by claims of a lack of funding or staff shortages.

I therefore, once again, request that you consider my complaint. Failure to do so will result in legal action against ICASA.

And oh yeah, I am VERY serious about this.

Try waiting three years and still ICASA do nothing your options are as follows next step is the public protector, make sure you have paid Telkom every miserable cent they claim, you might owe them or the public protector will not be interested in protecting your rights as a consumer, even if you do it seems debatable but rather be safe. I have reached a person in the government who is assisting, but not sure if this person would want details divulged on the net. The local and provincial governments is then probably the last step but not sure about that yet... I have waited 3 years and I demand an answer....

You mean I'm gonna have to pay them more than my current 1c a month? :D

On a more serious note, I fully intend on doing what I say in the email. I don't make idle threats.

I think MyADSL should also kick up a stink about the delay in them sorting out our complaint. I think everyone of us who emailed complaints to ICASA should email again and demand the IMMEDIATE resolution of our complaint.

I received a reply from ICASA early this morning, complete with apologies and acceptance of responsibility. I have emailed them back saying we can put this behind us and now focus on the VERY SERIOUS complaint at hand. Will keep updating MyADSL on how this progresses, as this is a very serious allegation that is being made.

I send a letter to the Competition Commission camplaining about unfair business practices (Telkom abusing their monopoly). First letter got lost :)

At least they have my letter now.

interesting case

Barkhuizen v Independent Communications Authority of SA [2002] 1 All SA
469 (E) indicates that the work load and time constraints on an administrative
body such as the Independent Communications Authority of South Africa
(‘ICASA’) cannot justify a failure to provide adequate notice to applicants of
their right to address the body on a competitor’s application. The court held
that ICASA had not been sufficiently pro-active, and had underemphasized
the importance of the applicant’s rights to be informed of competing
applications"

Fantastic dominic. Really really really fantastic.

Doesn't look like it will come to that, but, if needs be it will.

ICASA seem to be jacked about this now. They called me this morning as there had been a minor technical fault on my side.

Yes you read that right, ICASA called ME as I had made a mistake. Talk about role reversal!

Well at least you can be honest and eat humble pie... unlike some others we know...

Debbie2 just looking at your posts make me tired.
Where do you find time for all this

Geez the time I spend on Telkom stuff should be time I spend on my MA dissertation. I'm supposed to finish it by 15 Feb - yeah right! I've already applied for additional funding as there is no way in hell I'm gonna finish by then! :(
I'll just keep extending my registration month-by-month, Wits alllows us to do that. More worrying is the fact that I'm party to a contract wherein I can't get a job til this dissertation is finished :(

But life aint all bad. ICASA's taking notice of me, oh, and DSTV called me re: my complaints about advert sound volume. Small things that keep one going I tell ya.

Just an update: This complaint is in Icasa processes now. I got a call from Telkom this morning asking me to please directly email them a copy of my complaint. It seems Icasa had faxed (??) them my complaint and it was illegible to Telkom.

I think Mr George Candiotes, Telkom's mr bigshot lawyer, will not be happy to see my name come up again. Will keep informing MyADSL as this progresses. For now it good to know that things are being done.

@Debbie2 any more on DSTV? the advert volume is a bugger.

Nothing yet. I keep sending shoort emails to newspapers etc, trying to start arousing some public debate on this. I thought that perhaps a good thing to do would to be get decible measurements of the sound, and perhaps make a complaint to the relevant body suggesting that the advert sound is actually a HEALTH DANGER. I got this idea after seeing a story on CNN this morning about the daner of Ipod sound levels.
