IEC rules Winnie can stand for elections

The Independent Electoral Commission has ruled African National Congress heavyweight Winnie Madikizela-Mandela can stand as a candidate in this year’s polls.
The Democratic Alliance and the Freedom Front Plus objected to her inclusion on the ruling party’s national list for the elections because of her criminal record. But the IEC ruled on Monday that her inclusion is not against the country’s laws.

The DA’s James Selfe said the party had not yet seen the "full reasons for the IEC’s decision".

"When we receive them we will discuss those reasons with our legal team to see whether or not we should pursue this matter in the Electoral Court,” said Selfe.

Appeals against the IEC’s decisions on candidates must be lodged in the next three days.
The commission will finalise the process by the end of this month.

Hmmm . . . 2/3 of MP's in your parliament have a criminal record. Assault, fraud, failing to pay child support, are the main convictions. Why are you bothered if one more convict joins them? If this is the best your country has to offer, then so be it. Of course, some of you may complain, but the majority has spoken :D You are not the 'Crime Capital of the World' for nothing :D
 
I thought having a criminal record was a requirement to be an ANC parliamentarian? :confused:

Little bit of a different case here with winnie Intel++. Her case speaks to constitutional requirements, most if not all the other convictions don't.

I will be objecting to winnie's inclusion.

And I'll ask Selfe to pursue it in court.

Because we don't want criminals in parliament. It is not the best our country has to offer so we wont just let it be. What majority has spoken? The IEC doesn't really count as the majority. They are one body and it can be appealed.

Winnie is a has been and doesn't have much support these days.

Didn't expect that. I can't stand the woman. I think she's the biggest obstacle in the ANC.

Naah, he had to be 'exposed' and 'dumped'. He had the wrong 'color' to begin with :D After all ANC fights corruption on all levels :D Now who can tell me: Isn't Schabir Shaik in the top 10? :D
 
maybe the IEC took legal advice from the same lawyers as the Sport minister, Mr Stofile, when they advised him that the government owned the Springbok ;)

To use a phrase common in the early 90s.... "no duh!"
The important thing is we stand up, do what we can, resist where we can, bear witness, make a noise, record what is going on. Not sit back doing nothing but saying "yeah well i knew that was going to happen...".

On what grounds? She didn't spend at least 1 year in prison without the possiblity of paying a fine. Legally, she's allowed in.

Doesn't mean it's a terribly good idea, but there it is.

Being found guilty should be enough. Regardless of whether she spent time in jail. We all know the reason she get let off the hook here.

I know the law states something along the lines of the person being in jail but i think she's getting off on a technicality and that is annoying.

the objection is based on what the law says,
which is apparently something like this,
"you are disqualified from being an MP if you are convicted & sentenced to at least 1 yr without he option of a fine"

note that the law does not say you have to serve that 1 yr or more, it simply says sentenced... so by sum interpretations winnie is disqualified. but by ommission it does not disqualify her. this will probably have to be clarified possibly by the concourt.

Thanks for clarifying. Any ideas then how the IEC is going to justify this?
