iPhone battery replacement - help needed

My wife has an iPhone 5. Lately the battery does not hold it's charge anymore and it gets really hot during charging. She phoned iStore to enquire about replacing the battery and she was told that Apple SA does not have a legal right to open her phone and replace the battery. How can that be?

Has anybody else had such an experience or any advice on what we can do short of buying a new phone?

Considered that but don't want to fall into a catch 22 where if something else does break that istore can fix they refuse to as the phone was tampered with by an unauthorised 3rd party....
 
ever heard of android? they have replaceable batteries you know, much easier to just take it out and put in a new one...

Not every Android has this, in fact I think it is only Samsung that has removable batteries.
