BayTSP, Inc. ("BayTSP") swears under penalty of perjury that Lionsgate
Films has authorized BayTSP to act as its non-exclusive agent for
copyright infringement notification. BayTSP's search of the protocol
listed below has detected infringements of Lionsgate Films copyright
interests on your IP addresses as detailed in the below report.

BayTSP has reasonable good faith belief that Lionsgate Films, its
agents, or the law does not authorize use of the material in the
manner complained of in the below report. The information provided
herein is accurate to the best of our knowledge. Therefore, this
letter is an official notification to effect removal of the detected
infringement listed in the below report. The Berne Convention for the
Protection of Literary and Artistic Works, the Universal Copyright

Usenet, private torrent trackers, peerblockers and tor are your friends.
 
Wow! A thread about Abuse, downloading propriety content without paying for it! One never sees that!
 
Lol. as Praeses said use Peerblock.

Check your Afrihost control panel, there u will have to select its solved and think of some stupid reason. (or like me tell them to pissoff)

What happened here we see allot.
 
I recently (about a week ago) got one of these, one of my users must have been downloading something without using peerblock, honestly though what is the worst that can happen from here?
 
ISP's are obliged to forward the notices, but that's about it. I've never heard of anyone being punished for this in SA.
 
Do a search to find lots of threads on this on here.

Oh, and Peerblock is not infallible, guys.
 
Just move to a different isp. If you're on uncapped you'll get better performance anyway.
 
Peerblock will give you some protection at the cost of potential peers, but no intelligent copyright cop would be using an IP on the Peerblock list.

Illegal downloading using peer-to-peer technologies could result in some hefty fines, or worse, under South African law


While the Copyright Act of 1978 makes an outlaw of anyone who has ever ripped a CD they own to their PC or copied a song from their PC to a portable music player, it also protects the rights of artists, authors, software developers and other copyright holders.

But what punishment awaits those who use, watch, or listen to copyrighted material without obtaining a legal license for it first?

If you download content protected by copyright without owning a legal license for it then you're not a criminal, but the owners of the copyright would have a claim against you for damages, explained Nick Hall, an attorney at Michalsons Attorneys.

Such a claim “will usually amount to the purchase price of the good,” said Hall.

South African law criminalises those who distribute copyrighted content without the permission of the copyright holder.

Selling illegally obtained copyright material is an offence in terms of both the Counterfeit Goods Act as well as the Copyright Act, said Jenna Cuming from Chetty Law.

Hall said that even if your intent isn't to sell and you distribute such material for free you are guilty of a crime under the Copyright Act. This includes uploading content, even in part, using peer-to-peer (P2P) technologies such as BitTorrent.

Cuming provided the punishments for the crime from the Copyright Act:


1.In the case of a first conviction you could look at a fine of up to R5000 and/or 3 years imprisonment for each copyrighted item distributed.
2.In any other case a fine of up to R10 000 and/or up to 5 years jail time per copyrighted item.

Hall added that the criminal punishment is over and above the damages that are payable to copyright holders for illegally copying their material.

Enforcing this law can be tricky, however. The police can't simply show up at someone's home to inspect their devices for material that potentially infringes copyright.

Cuming explains that the police would need a search warrant issued by a judge who feels there is reasonable probability that a crime is being committed at the premises."

Two points I'd like to make:

1. ISPs ~ do not care what you are downloading/sharing. They send out these emails as a matter of course when they receive notice from BAYTSP or whoever.

2. The email amounts to nothing more than an allegation of copyright infringement. You have not yet been found guilty of anything.

3. ISPs know that people pay them good money to use their services for the purpose of downloading movies/TV shows/music/games/software that they might otherwise have to pay for. They don't want to know what you're doing as long as you're paying them and they don't want to police the internet for any third party.

Ok, that was 3 points.

Believe it or not ... they do not change their originating IP addresses that often!
