Purchased an iStore gift card (mistakenly thought it was an itunes gift card as per the Google search, for which their AdWord shows up and directs you to their website.)

Here is the product page: https://www.myistore.co.za/gift-card?gclid=CP-Pgo2-ydQCFcqd7QodPykB_Q

I realised how silly I was afterwards, and requested cancellation and a refund (7 minutes after placing the order).
They've now informed me that as per their T&Cs, it's non-refundable.

It doesn't state that on the product page, but I do see it on their store T&Cs.
Is this something I can fight, or should I just cut my losses?

:erm:

Try going CPA on them. I believe you have the right to request a refund.

However, I am not sure if CPA applies if the item was not faulty.

Why not just use the card to buy credit for the iTunes store?

It was for father's day and they weren't able to issue it in time, so I ended up purchasing it elsewhere. Surely though I would be eligible for a refund, if this is just an in-store currency which they are able to activate and de-activate

They are full of s**t with that card. I had one but lost it, and it still had R140 on it - wanted them to issue me a replacement one but they insisted they couldn't do it. They need to make their own systems a little more flexible and customer service oriented.

Expecting service from Core Group, that's the first mistake right there.

The CPA state's that you can return it for refund or exchange within 7 day's no reason nessasary.

UPDATE:

After complaining multiple times and having it "escalated to the higher echelons", they've agreed to refund it.

Value of the card an location?

The CPA does not cover the purchaser in the instance described in the OP, regardless of your understanding of what Google adwords are.

It's not my understanding the definition of direct marketing includes online adverts. Corporations cannot bypass this law because they include "no refunds or exchanges" in the terms and conditions.

Good for you. What you will find, however, is that the act itself, as promulgated, supercedes a wiki entry.

Can you please point out the relevant parts of the act itself, where this is defined and promulgated? Or a link to the relevant parts would be great.
