Doesn't the basic conditions of employment legislation say 21 days of leave?

If the employee only works for 5 days a week then that employee gets 1.25 days of leave per month which amounts to 15 days per annum :)

Which is true to the calendar, however that IT position will contractually bind the employee to additional hours.

The Basic Conditions of Employment Act can be somewhat vague. If the employee is only employed for 5 days a week, the employment contract may state that additional hours may be required. Those hours however still does not change the employment agreement of 5 working days as the hours are not and cannot realistically be set unless the employment agreement is changed to a 6 day working week or possible 7 days a week.

The employment contract must make provision for overtime in case additional hours may be required from the employee.
An employer may not force an employee to work overtime without overtime compensation. The employee also has the right to decline working overtime on short notice unless the employment agreement states that he must be available to work overtime on short notice (which in I.T Support happens very often).

Also, should an employee earn more than R205 433.30 per annum, an employee may only work overtime if agreed to between the employee and the employer. The employer cannot demand any overtime hours in this case.

This still happens a lot. You would be surprised. Even the company I work for use terms like that in the job specifications for I.T Staff.

Jeeze you lot bitch like old woman with wet panties..

Only for blacks

Its not only for blacks, please use your google to better understand the South African definition of BEE.

racist company. avoid.
No they are not, as with most companies in this country they are forced to comply with BEE regulations, therefore a certain percentage of staff within this threshold need to be BEE, they are ensuring compliance.

Anyone else find this hilarious - WhiteRaven posting
That is quite funny - FYI a WhiteRaven is an albino black raven that is shunned or killed by other ravens. Pretty much what you guys do to recruiters.

I know of many companies that would rather employ the correct people regardless of race than to get a better BEE rating.

+1 to avoid.

No company is forced to comply with BEE policies. It is not a legal mandate.
If you avoid doing business with government and other companies who insist on BEE suppliers/service providers, then you're free to do whatever you like with your company.
Companies who subscribe to BEE policies should be regarded as traitors.
