Jail time for BBBEE 'fronters'

Deputy President Cyril Ramaphosa has told MPs that companies and individuals found guilty of "fronting" BBBEE statistics could now face a jail sentence of up to ten years.

Ramaphosa told the National Council of Provinces on Wednesday that the BBBEE advisory council had become aware of the "growing" practice, and agreed that penalties should be imposed on offenders.

"If you are found guilty of fronting, your business could face a penalty of up to 10% turnover, as well as 10 years in prison for individuals.

"A person convicted of such an offence, will also suffer by not being able to transact with the State for a period of 10 years."

Ramaphosa said BBBEE is one of the most important measures that the democratic government had put in place to address the economic injustices of the past.

He said the original drafters of the BEE Act didn't envisage that companies would work against active transformation, and therefore the need arose to criminalise it.

"Fronting in the end is not a victimless crime," he continued.

"The perpetrators of fronting practices often target the vulnerable, the poor, the uninformed and deprive those most in need of opportunities that should rightly be theirs."

Ramaphosa was confident that with time, business will steer clear of trying to skirt BBBEE requirements due to the penalties involved.

'One-stop investment shop'

The deputy president also informed the Provincial House of the department of trade and industry's progress in setting up a "one-stop-shop" for potential investors in the country.

"Invest South Africa has been set up, to assist those that want to invest in our country, and to ensure all their difficulties and challenges are addressed quickly."

Ramaphosa said it combined all government services in one office, and will fast track investment in the country.

Invest SA will combine the services of SARS, home affairs, environmental affairs, water and sanitation, and importing/exporting permits.

Ramaphosa cited a pilot run through automobile manufacturers Beijing Auto Works, who used the programme, invested R11bn.

He said all stakeholders, government, business and labour, were all happy with the scheme.

Wonder what they call fronting when you work in a Gov department and get a friend to register a company to supply your department?

The BEE acronym is a bald faced lie. There is no "Economic" component to advancement considerations and never has been. There is no means test to be eligible for BEE, only race. You can be a billionaire and still get preferential treatment since the only requirement is your race, not your economic circumstances. Even your children will still get preferential university admission, etc. And this will seemingly apply in perpetuity.

Take the "Economic" out of it, and call it what it is - Black Empowerment, for all time, regardless of how wealthy you already are.

I say drop the B and just make it strictly non racial Economic Empowerment purely based on your economic status. This will automatically favor the demographic that most needs assistance, and prevent the distortions created by a small group that have learned how to leverage the system to amass wealth.
 
Slightly off the subject...

Up on the mine here, every year the mine sends it's suppliers paperwork to register as a preferential supplier, meeting certain criteria, including the race one.... I refuse point blank every year to fill it out, telling them they can get their stock from other "empowered" suppliers...... and every week, the mine still sends me orders for stock, due to the fact that my pricing is better, my delivery time in well within their allocated time and the other "empowered" suppliers don't always have the capital to purchase the initial order....
 

Do you think BEE is working as intended? Do you believe that wealthy black individuals and families should continue to benefit from BEE indefinitely, long after they have any need for economic empowerment?

Do you believe that it is morally defensible that impoverished people of one race should be singled out and permanently excluded from economic empowerment?

What is your moral basis for supporting a racially based BEE policy as opposed to non-racial EE which, if based on means testing, would automatically disproportionately benefit those groups that most need it anyway, but only for as long as they genuinely need it, freeing up resources to be more widely distributed?

Can attest to that too. They will bypass when it suits them, same way they bypass with employment when they need pilots, doctors, specialists and so forth. Their 'principles' are very wishy washy when it comes to fulfilling their own needs.
