The so-called "Modimolle monster" Johan Kotze and his ex-wife Ina Bonnette respected each other, he told the High Court in Pretoria on Tuesday morning.

He is accused of assaulting Bonnette, killing her son and forcing his workers to gang-rape her.

"It was a happy marriage. The problems we had came from outside," Kotze told the court.

He wore a beige jacket and jeans, and spoke calmly. His lawyer Piet Greyling asked the court if he could have some water.

"We had respect for each other," Kotze testified.

However, he said they broke up several times before getting back together again. He obtained a protection order against Bonnette after their second break-up, but went back to Modimolle on November 19 to try and reconcile.

The couple discussed the possibility of renting a house together, he said. He rented the house on his own in Modimolle.

"We decided to see each other in secret, to keep the relationship from her parents for the time being... Our focus was Christmas and New Year, when it is family time. Then she would reintroduce me to her family."

On Monday Greyling told the court he would argue non-pathological incapacity as a defence, even though three psychiatrists had found Kotze fit to stand trial.

The State closed its case on Monday on condition it could call expert witnesses to testify on Kotze's accountability. Greyling said he would object to this, and argued the State should call witnesses before closing its case.

Acting Judge Bert Bam said the matter would be dealt with if and when it arose. "We will cross that bridge when we get to it."

Kotze, Andries Sithole, Pieta Mohlane and Frans Mphaka are accused of murdering Kotze's 19-year-old stepson Conrad Bonnette at Kotze's house in Modimolle on January 3. They are also accused of kidnapping, assaulting, repeatedly raping, and attempting to murder Ina Bonnette earlier that day.

A plea of not guilty was noted on Kotze's behalf after he refused to enter a plea, and claimed his accountability and ability to follow and contribute to court proceedings were in question.

His three co-accused all pleaded not guilty to the charges. They claimed Kotze forced them to take part in the attack on Bonnette and said they had only pretended to rape her.

Bonnette testified Kotze tortured her with various objects before instructing the other three to rape her. She told the court she listened to her son pleading for his life before he was shot in the head and heart.

Kotze Threw Kitten in Anger

The so-called "Modimolle monster" Johan Kotze emotionally told the Pretoria High Court on Tuesday he threw his daughter's kitten from his bed the night he saw his wife with another man.

"I did something I never do.... I very aggressively threw [the kitten] away from me."

He is accused of assaulting Ina Bonnette, killing her son and forcing his workers to gang-rape her. Kotze testified he saw Bonnette with another man at a dance on New Year's Eve in 2011.

"I was terribly upset. I froze," he said, taking long pauses and looking at his feet.

Judge Bert Bam asked Kotze if he needed to take a break, but he declined. He said he saw Bonnette hugging and kissing a man with whom she left the dance hall. He followed them.

"It was clear they wanted a relatively dark place where they could be their normal selves. I don't know what went through my head. I was probably powerless."

He said he later left and went to his house, then went to Bonnette's house.

Bonnette attended court proceedings on Tuesday morning. She often shook her head during Kotze's testimony.

Earlier, he said he and Bonnette respected each other.

Kotze did not see the Rape

So-called "Modimolle Monster" Johan Kotze told the High Court in Pretoria on Wednesday he did not see his three co-accused rape his ex-wife Ina Bonnette.

Lawyer Jan van Rooyen, for accused number two Andries Sithole, asked Kotze if he saw Sithole, Pieta Mohlane and Frans Mphaka rape Bonnette on January 3, 2012.

"It is what I experienced. I did not see it at all," Kotze said.

Van Rooyen asked if Kotze saw any of his co-accused penetrate Bonnette either with an object or a penis.

"I did not see anything," he replied.

Both Bonnette and Kotze's daughter, Jo-Marie Kotze, were in court on Wednesday.

Van Rooyen asked whether any of the men had asked or demanded anything from him or Bonnette.

"No. They only asked for food," he said, adding he could not comment on Bonnette's behalf.

Kotze denied telling Bonnette she would know what it felt like to have three black men rape her.

He denied ordering the three to masturbate to get erections, and denied telling Sithole to climb on top of Bonnette and later telling him: "It's enough, get off."

"No, Your Honour, it's not true," he told the court.

Kotze is accused of orchestrating the gang rape of Bonnette, and of murdering her son Conrad, 19, in his rented house in Modimolle on January 3.

Co-Accused were Afraid

The co-accused of so-called "Modimolle Monster" Johan Kotze feared for their lives, the High Court in Pretoria heard on Wednesday.

Jan van Rooyen, for accused number two Andries Sithole, put it to Kotze that he threatened the three men and told them to rape his ex-wife Ina Bonnette.

"You were aggressive. You said no k****r will tell me what to do and you will do what I say," Van Rooyen put it to Kotze.

"Your Honour, I did not make that statement," Kotze said.

Van Rooyen said Kotze ordered Sithole, Pieta Mohlane and Frans Mphaka to hide in a room in his Modimolle house, where Bonnette was attacked.

He said Sithole had believed the threats were real.

"I did not have something with me. I did not have a weapon with me," Kotze said, asking how he could have threatened them.

Van Rooyen said Kotze told the men to pin down Bonnette. Kotze denied this.

He said Sithole simulated raping Bonnette by moving up and down. Sithole told Kotze he was afraid and could not get an erection.

"I didn't see Andries do it.... There was no such talk," Kotze said.

Van Rooyen said Kotze told Sithole, when he failed to have sex with Bonnette: "It's quite funny. If you rape you are good, but when it is arranged for you, you can't do anything."

He said that when the other co-accused were also unable to have sex with Bonnette, Kotze chased them out.

"Your Honour, it's not true," Kotze said.

Van Rooyen put it to Kotze that his client's version of events supported Bonnette's testimony.

"It is not true," Kotze repeated.

Kotze can't recall Mutilation Court Hears

The so-called "Modimolle monster" Johan Kotze testified on Thursday that he could not remember mutilating his ex-wife's breasts and genitals.

"Your honour these things happened..., but I can't remember what happened that day," he told the High Court in Pretoria.

Prosecutor Retha Meintjes described Ina Bonnette's injures to Kotze. He either denied inflicting them or said he could not remember doing so.

Meintjes presented a side-cutter, a nail, and a knife to the court and told the court how Kotze had cut off Bonnette's nipples and cut her genitals.

She put it to him that after cutting off parts of Bonnette's nipples, he had pushed a nail into her wounds.

"I never used a nail.... I never had a nail," Kotze said.

He admitted to being enraged while Bonnette was tied to the bed in his rented Modimolle house on January 3, 2012.

"I know I walked around.... I picked up the [side-cutter] and I was very angry."

He said he threatened her with it and only remembered seeing blood. He did not realise he had hurt Bonnette until he saw blood. "Then, I stopped."

He said he had only an image of bleeding from one of Bonnette's breasts.

Meintjes asked him about a coagulant he had used on Bonnette.

"I wanted to help her," Kotze said.

He said it was used to stop bleeding, but that on second thoughts he would not have used it.

Kotze is accused of orchestrating the gang rape of Bonnette, and of murdering his stepson Conrad, 19.

His co-accused Andries Sithole, Pieta Mohlane, and Frans Mphaka are also charged with kidnapping, assaulting, repeatedly raping, and attempting to murder Bonnette that day.

Bonnette and Kotze's daughter Jo-Marie Kotze sat in the public gallery again on Thursday.

Meintjes asked Kotze why he had not untied Bonnette.

"This was one of the things that bothered me.... I can never think why I didn't untie her."

Meintjes asked him how he seemed to remember some events, but forget others which happened that day.

Kotze said his memory since New Year's Eve 2011 had been affected. He testified that he saw Bonnette cheating on him.

"This is a condition that is very serious for me," he said.

Ex's Cheating was Treasounous says Kotze

The adultery of his ex-wife Ina Bonnette was treasonous, the so-called "Modimolle monster" Johan Kotze told the High Court in Pretoria on Thursday.

"I do not get renounced like that. It was treason against me," Kotze said.

He was responding to a question by prosecutor Retha Meintjes.

She asked about his emotions on the night he found out about his then wife's infidelity. He went to a dance on New Year's Eve 2011 and saw her lovingly interact with another man.

Kotze testified he watched them without their knowledge.

"I could not believe what I saw."

Kotze said however difficult it was for him, he still went to her home and watched them further.

"It just broadened the picture. It was a total lie."

Kotze said he had many questions about her fidelity during their marriage and observing what he saw on New Year's Eve explained a lot to him.

"It is unacceptable."

Meintjes asked what more he hoped to see by following them to Bonnette's house. She argued he already saw she was with someone else.

"Exactly what I saw that night... I'm happy I saw it," Kotze said.

He testified he saw them kissing and the man touching her breasts.

Meintjes told him despite watching them he never acted or confronted them.

"I am not someone who would storm in and hurt people," Kotze said.

He said he was betrayed by her infidelity. He had sold his farm in Bloemfontein and they had bought a house together.

"We were supposed to become one family."

"I can't remember something like that at all... There was no reason. I did not want to do it," he said.

At the end of the day Judge Bert Bam asked Kotze if he thought about what happened when he left the house, if he thought he had committed an offence.

"Not at all," Kotze said.

"I did not think of Ina or [Conrad] when I left the house."

Bam asked why he then went on the run. Kotze explained he did not flee, but merely got into his car and drove.

The trial continues.

Kotze knew he had committed a Crime

So-called "Modimolle monster" Johan Kotze has told the High Court in Pretoria he realised he had committed a crime when his ex-wife was assaulted and her son killed.

Judge Bert Bam asked Kotze on Friday whether he knew he had committed an offence against Ina Bonnette.

"Yes, I believe so," Kotze replied.

Bam asked him the same question about Bonnette's son Conrad. Kotze said he had realised what he had done when he heard news reports on Conrad's death while he was on the run.

"Condrad's thing upset me terribly and I could not believe I shot him dead."

Bonnette was still married to Kotzé, but lived in her own flat at the time.

Clinical Psychologist Testifies

So-called "Modimolle monster" Johan Kotze is not accountable for his actions, a clinical psychiatrist told the High Court in Pretoria on Friday.

"I am of the opinion that Mr Kotze was not accountable for the alleged actions of which he stands accused," Tertia Spannenberg said.

Spannenberg was called by Kotze's defence counsel as a witness.

She said Kotze had a narcissistic personality disorder and was obsessed with Bonnette. When he saw Bonnette with another man on New Year's Eve 2011 it caused trauma, which led to stress disorder.

He became dissociated when, during an argument on January 3, 2012, Bonnette put a vibrator on the table of his Modimolle house and told Kotze to use it on his next wife.

Spannenberg read her report on Kotze into the court record. She first assessed Kotze in October 2012 at the Pretoria Maximum Prison. The interview lasted four hours.

"There was a sense of urgency on his side to convey his life story to me."

She told the court the parts of the attack Kotze said he forgot were consistent throughout her assessments.

"He was very frustrated about aspects of the incidents he could not remember."

Spannenberg told the court he could not relate to the fact that Conrad Bonnette was dead.

"I cannot kill Conrad," she quoted Kotze saying.

She said he never referred to Conrad's death in the past tense.

"I would never be able to kill Conrad. I cannot shoot Conrad."

She said this was consistent in every interview.

'Monster' Report Subjective: Expert

A psychological report on the so-called "Modimolle monster" Johan Kotze is subjective, the High Court in Pretoria heard on Monday.

Clinical psychologist Tertia Spangenberg initially said the report was not subjective, as Kotze did not know the criteria for dissociation, and had merely answered her questions.

However, Judge Bert Bam put it to her that the report was based on what Kotze had told her. She agreed.

Kotze is accused of orchestrating the gang-rape of his former wife Ina Bonnette and of murdering his stepson Conrad, 19, in his rented home in Modimolle on January 3, 2012. At the time, Bonnette was still married to Kotze, but lived in her own flat.

In her report, Spangenberg found Kotze was not accountable for his actions.

"It is my opinion that the combination of Mr Kotze's narcissistic personality disorder, superimposed on traumatic psychological injuries, combined with an unmanaged, long-standing, major depression and untreated and unresolved acute stress disorder, resulted in a state of psychological dissociation during his alleged criminal acts."

Bam asked her on Monday when this dissociation started and ended.

She said the dissociation would have started during an argument between Kotze and Bonnette on January 3.

Bonnette presented him with the couple's vibrator and told him to use it on his next wife.

However, Spangenberg could not say with certainty when it ended. She testified that Kotze appeared to remain dissociated when he was in his car after the attack.

Bam put it to her that Kotze testified he had known he had committed an offence when he left the house.

Spangenberg said Kotze did not tell her this during their evaluation.

She earlier told the court Kotze's case was the first she had done involving diminished capacity.

The defence for Kotze's co-accused requested that it cross-examine Spangenberg after the State, as it needed a report on Kotze which another psychologist compiled last year.

State Questions Kotze's Irrationality

The State on Tuesday questioned the report of a clinical psychologist which states the actions of the so-called "Modimolle monster" were irrational.

Prosecutor Retha Meintjes cross-examined clinical psychologist Tertia Spangenberg in the High Court in Pretoria on her report on Johan Kotze.

Meintjes put it to Spangenberg that Kotze's actions -- giving orders to his co-accused, walking to a closet to collect tools to mutilate Ina Bonnette's genitals, pulling the trigger, and reloading the gun --appeared to be rational.

"These are complex actions," Meintjes said.

Spangenberg agreed, based on the State's version of events.

"Given the State's evidence it may be rational."

She added, however, that to actually give these orders was not rational.

Kotze's Testimony Perhaps Altered

Johan Kotze, the so-called "Modimolle monster", could have altered his testimony concerning his finances, the High Court in Pretoria heard on Wednesday.

Clinical psychologist Tertia Spangenberg said during cross-examination it would be difficult for a narcissist, which she believed Kotze was, to discuss financial problems.

She said he would want to keep up his social standing and the way he was perceived.

Francois van As, for two of Kotze's co-accused, asked her if this would have influenced his testimony on his finances.

"It would have influenced his testimony," she said.

At which point Judge Bert Bam asked whether the rest of his testimony could also have been influenced.

Spangenberg said it would not necessarily affect the rest of his testimony.

She said Kotze's narcissism crumbled when he lost face in public after being accused of murder and assault.

Van As asked whether this meant Kotze was no longer a narcissist.

Spangenberg answered: "No that is not what I meant. He still is one".

On Tuesday and throughout Wednesday morning Spangenberg was cross-examined on differences between her report on Kotze and that of another clinical psychologist.

Spangenberg, who was called by Kotze's defence, found he was not accountable for his actions. She found Kotze had a narcissistic personality disorder, major depression, and untreated and unresolved acute stress disorder, which resulted in a state of psychological dissociation during the attack.

She said individuals with his narcissistic disorder were noted for their egotistic self-involvement.

According to her findings, Kotze was obsessed with Bonnette. When he saw her with another man on New Year's Eve 2011 it caused trauma, which led to stress disorder.

"I am of the opinion that Mr Kotze was not accountable for the alleged actions of which he stands accused," she said last week.

In contrast, clinical psychologist Dirk Coetzee, who assessed Kotze at Weskoppies psychiatric hospital in Pretoria, found he could be held criminally responsible for his actions.

His report was handed in as evidence on Tuesday afternoon.

"At the time of the commission of the offence the accused was criminally responsible for the offence charged, and was capable of appreciating the wrongfulness of his act and could act in accordance with an appreciation of the wrongfulness of his act," Coetzee's report read.

Coetzee spent seven-and-a-half hours doing his assessment on Kotze at Weskoppies. This was spread over five visits. He described Kotze as co-operative and attentive during interviews.

"At the time of the incident he did not suffer from any clinical psychiatric disorder."

Coetzee said Kotze showed traits of a compulsive personality. Some depressive symptoms were also noted.

State's Application Halted

The judge in the trial of so-called "Modimolle monster" Johan Kotze said on Tuesday he will decide later whether to allow the State to reopen its case.

High Court in Pretoria Judge Bert Bam said he would consider the matter only after the cross-examination Andries Sithole, one of Kotze's co-accused.

On Wednesday, prosecutor Retha Meintjes indicated that the State wanted to reopen its case to present evidence about Kotze's criminal accountability in rebuttal of testimony by defence witness Tertia Spangenberg, a clinical psychologist.

She had testified that she did not consider Kotze accountable for his actions. He dissociated during the attack, and suffered from a number of conditions including narcissistic personality disorder and major depression, she told the court.

The defence has opposed the application. On Monday, Kotze's counsel Piet Greyling submitted that Kotze would be financially drained if the court proceedings were extended.

He contended that the State had made an informed decision when it failed to call clinical psychologist Dirk Coetzee, who assessed Kotze at Weskoppies psychiatric hospital, in Pretoria, before closing its case.
