So why can I not perve at my neighbours with a pair of binoculars, or take pics of them walking around starkers.

perving at your neighbours with binoculars suggests to me they're indoors, and you can't get a clear view of them without going the extra mile. That's a peeping Tom. It's different if they're standing on their balcony, starkers. (Said balcony being visible to anyone passing by). Nothing to stop you from taking pictures of them if you want to. You can always justify it by saying you plan on laying a charge of public indecency and the pics are proof for the police :D

a peeping tom trespasses on private property and peeps through bathroom windows.
A paparazzi stands on public property and takes pictures of celebrities who are visible to the public.

Not really the extra mile. Not in this context anyway. It's not the equipment used that's the issue, it's the location of the subject. Photographs of them in their bedroom, taken with telephoto lens is one thing. Of them on an open the balcony is quite another.

Anyway, I'm pretty sure they were aware of the existence of telephoto lens, and have been pictured with them in the past. All of that is what they needed to have factored into their decision to be on the balcony.
 
Boobs usually distract us from everything else. In this thread it appear to be the opposite. :what:
 
Woopy-****ing-doo. Part of me feels quite sorry for the fact she is now the target of bottom feeding sleaze rag buyers (I don't even blame the photographers).

The other part of me knows she must have realised what she was getting into so she is feeding this sensationalism.

What if the balcony has a glass surround - does that suddenly mean it's 'inside the house ' ?

Kate and co could not be clearly seen from where the photographer was so the fact that a telephoto lens was needed makes in intrusion.

You are over simplifying.
There are a myriad of factors which would determine whether you would be arrested or just shooed away.
I gave you the two most basic ones.
But yes, if you leave the window or curtains open and stand nude in front of it, don't be surprised if people standing in the street start taking photos.
And if you tried to sue them, you would not have a leg to stand on. You are more likely to be arrested yourself.
But if there is one solitary person out in the street stalking you, or standing there for hours with a camera or binoculars, then you should probably call the police.
 
This is intrusion, not just being caught starkers in view of passers-by.
