There will be no prosecution. Celebrity on an open Balcony = Fair Game (at least from the Paparazzi POV... and the French).
 
France has some of the strictest privacy laws in the world and it is forbidden to take photos of anyone on their private property without their consent.

It means that Laurence Pieau, the editor of Closer, and the photographers involved in taking the pictures, could receive a year in prison and a maximum fine of 45,000 euros.

i don't understand this. with princess di being so publicly hounded like she was this should have been enough for her not to have done this. she knows well enough that she is now public property just like princess di and anything she does or says is going to be published. she knows only too well what hell princess di went through so why put herself in the front line. this is looking for attention. nothing will keep the papparazzi from getting that photo of them or her. this is just plain stupid if you ask me.
