Keeping an Item aside for someone

It's not a moral issue. The first buyer loses nothing if the deal falls through. Plus in these situations the seller loses the sale all too often. It's a business ethics question if anything and the first ethic in business is sell high. If you want to secure a purchase pay a deposit.
But he said he would keep it aside for him.

I'm sorry but giving away almost half the value of your items for kindness sake is charity and no one is obligated to perform acts of charity. Things change and people need to grow up.

But he said he would keep the stuff aside for him and didn't ask for a deposit.

And what if the first guy cannot come up with the money?
Exactly. Had it happen and seen it happen plenty. Turn down a cash offer because fccknut number one promised he'd take it and lose the sale when they don't. Cash on the barrel. South Africans are k@k at business. Business is about money not sentiment.

some years back i sold a set of top-end turn tables and a mixer, all in very good condition. the first guy (mid twenties) who came to look at them arrived dressed in brand name clothes in a fancy car and made me an offer which i refused.

a couple of hours later a boy under twenty arrived in an old bakkie. he was shaking with excitement and said he'd been working and saving up for some decks for ages. then the first guy's mother phones and says her son wants them desperately and she offers to up the price.

what a delight to see the second chap drive off so chuffed. the price didn't even matter.

so, my advice, phone the first guy and tell him what's happening. he might have changed his mind.

If the other dude is genuinely offering the amount and actually has the funds to pay you, do it. Not really a dick move, but a business one.

So I called the first guy and naturally he was upset and told me what a douche I am. But I'm going with Nick333 advice, its not about charity and sentiment, it about business and my own well being.

Nobody cares about the first guy and what he feels. You were selling items, he couldn't come up with the cash and the other guy could, and the value you sold the items for was more.

Correct me if I'm wrong but is this not basic contract law?

You offered something, Guy1 made a counter-offer, you accepted the counter-offer.

As far as I can see you're technically wrong but then again I'm no lawyer and this is just my basic understanding of a subject I did ages ago.

I remember something vaguely similar from a subject i did back at uni, hence why I asked the question. But I gave it some thought and the guy didn't stick to our initial agreement. He was suppose to come back to me last week Wednesday, but then he just called and told me he will pay friday. Friday came and I didnt hear anything from him. Monday morning this other guy came with his offer and said he is going to bank to organize the money asap before the first guy takes the stuff. Just after that, the first guy called and asked me to send my banking details.

I guess it's almost the same thing like with deals on Gumtree.
Person X calls me to say they want it but can only get it pay day. I go and say fine, I'll keep it, others call wanting it but I am nice and keep it.
Come pay day, Person X can't take item, something came up, now I'm back to trying to resell it.
Every deal I make now is a first come first serve thing.

Nothing wrong with it, as long as you specify that you are not keeping the item back. If you do promise to hold it back, then that is exactly what you should do.

@OP, seems like guy1 did not uphold his end of the bargain to pay within the agreed upon time, therefore you free to sell to whoever you please.
