Police sergeant Manape Phineas Kgoale thought he was responding to a hijacking outside the Kempton Park police station when he shot dead a woman, his affidavit says.

Kgoale said a car guard had come into the police station last Tuesday shouting that someone was trying to hijack a car.

'I... thought it was a gunshot'

"I went outside and heard a loud noise and thought it was a gunshot," he said in the affidavit, read out in the Kempton Park Regional Court on Wednesday by his attorney Riaan Louw.

"I saw a car going backward and forward."

He could not see the face of the person behind the wheel because of the poor lighting, given that it was 7.50pm.

"I saw the person move their hand to the right shoulder and thought they were going for a gun. My call for them to stop went unheeded."

No time to fire a warning shot

He said there was no time to fire a warning shot.

"I aimed for the shoulder but somehow it changed course and hit her in the chest," he said.

Only later he saw that it was a woman driver.

Kgoale denied that the car guard was present as reported in various newspapers.

Kgoale shot Jeanette Odendaal last Tuesday at the Kempton Park police station after she crashed into a stationary police car. The bullet entered Odendaal's left arm.

So was deadly force necessary? Or would shooting the tire out suffice?

People carry guns on their right shoulder ? - or is that where they reach for the seat belt ....

He could see the shoulder, the right hand moving upwards, but he couldn't see the long female hair ?

He was next to the window, aimed for the shoulder but missed ?? Really ?

Throw this lying bastard behind bars and tell the other inmates who he is.
 
Think of it this way .. lets say someone was hijacking the car AND HE DIDN'T SHOOT then you all would be saying "WHy didnt he shoot the guy " and Police need to take more action etc ...

My gun does not make crashing sounds. Weird. Maybe he did not know what a gun sounded like?

And when you do this you also normally turn your face in that direction.

Exactly, why did you say it was the right hand?

Does anyone know what the lighting is like outside the police station? Usually they have quite a few flood lights.

He only wanted to prove he was mental. He did not know what he did. :mad:

Murder-accused cop might be unstable

Johannesburg - A policeman, accused of shooting dead a woman at a police station last week, may be mentally unstable and pose a threat to society and himself, the Kempton Park Regional Court heard on Thursday.

The State asked for a postponement of the bail hearing on Wednesday because it needed clarity on the mental and psychological state of Manapa Phineas Kgoale, 38.

"There are numerous aspects for the investigating officer to clear up," said prosecutor Lynette Lambert.

She said the sergeant had a history of alcohol abuse and was referred for police counselling as a result of emotional stress.

The stress was apparently caused by his girlfriend not wanting him to see his child.

Freed from rehab centre

Kgoale was released from a rehabilitation clinic for alcohol abuse a week before the shooting.

"The State is concerned with the accused's mental state and well-being, taking into account his trauma.

"Because of the facts of this case, we must look at public interest...we need a preliminary report on his mental well-being, and decide whether he is a danger to the public and whether he is a danger to himself," said Lambert.

"We must make sure that if this accused gets bail he doesn't kill someone and that he doesn't kill himself."

Lambert said there were many questions that needed to be answered.

"What he did is indeed unusual and strange."

Defence: Cop is not mad

Defence attorney Riaan Louw opposed the postponement, saying his client was not mad.

"When my client was released from the rehab clinic they found him to be fit and proper and told him to return to his duties.

"If the State wants to know why the incident took place, we have answers to give during bail," said Louw.

"What they are implying is that my client has a huge psychological problem and that he is mad. Well I can tell you he is not mad."

Louw accused that State of fishing for problems because of all the media attention.

He said the State intended opposing bail because of the rehabilitation and a firearm training course that Kgoale underwent this year.

"They want to know, if he went for training, how [did] this happen?

No history of violence

"We are confident we have a valid defence...the State cannot keep the accused in custody because they want to do further investigations."

He said it did not mean that if a person had an alcohol problem that he was a threat to society.

"Half of our society has a drinking problem. Let us put the facts before court and let the court then decide whether to send him for mental observation. There is no history of any violence or him hurting anyone or having any problems," said Louw.

The sergeant allegedly shot dead Jeanette Odendaal at the Kempton Park police station last Tuesday after she drove her car into a stationary police vehicle.
