Bloemfontein – Abathembu King Buleyekhaya Dalindyebo had three years shaved off his 15-year jail sentence on a raft of charges, in a Supreme Court of Appeal ruling handed down on Thursday.

He succeeded only in having his conviction on a charge of culpable homicide and the accompanying 10-year jail sentence set aside. The SCA dismissed the rest of his appeal.

In 2009, the Eastern Cape High Court sentenced him to in effect 15 years for seven counts of kidnapping, three of assault, three of arson, and one each of defeating the ends of justice, culpable homicide, and defeating the ends of justice.

His trial dragged on for five years, largely due to his own “dilatory and obstructive” behaviour, the SCA said in its ruling. He changed lawyers 11 times. There were at least 34 postponements.

The delay was also due to the fear he induced in his subjects and the influence he exerted.

“His behaviour was all the more deplorable because the victims of his reign of terror were the vulnerable rural poor, who were dependent upon him,” the SCA ruled.

DA cancels King Dalindyebo's membership

Bloemfontein – The DA will cancel King Buyelekhaya Dalindyebo’s membership after the Supreme Court of Appeal (SCA) on Thursday upheld his conviction on charges of kidnapping, assault, arson and defeating the ends of justice.

Democratic Alliance spokesperson, Refiloe Nt'sekhe, said the decision was in line with the party’s constitution.

The SCA replaced the abaThembu king's 15-year jail sentence with a 12-year term. It said he was lucky not to have received a heavier sentence.

He succeeded only in having his conviction on a charge of culpable homicide and the accompanying 10-year jail sentence set aside. The SCA dismissed the rest of his appeal.

Dalindyebo joined the DA in July 2013 after he had described the African National Congress and President Jacob Zuma as "corrupt hooligans".

He made the remarks in Qunu, in the Eastern Cape, at a prayer service for late former president, Nelson Mandela.

Dalindyebo said the ANC had distorted the anti-apartheid icon's legacy and behaved arrogantly. He said he would stop smoking dagga the day Zuma stopped being corrupt.

The royal family subsequently apologised to Zuma.

Amazing how quickly his problems escalated after he dissed zuma and the anc.

I think he was more than an ordinary member, important enough for Trollip to personally welcome him. He was trouble and the DA knew this.

Who wants to go to jail for King Dalindyebo?

The Council of Traditional Leaders is looking for a chief to take the place of King Buyelekhaya Dalindyebo in jail according to a report.

eNCA reports that the council is calling on the abaThembu nation to appoint a chief to go to jail in the controversial leader's place.

According to the report the NPA has dismissed the idea.

The king meanwhile will not be going to jail today - as his lawyers have managed to extend his bail for two weeks.
