Has anyone been caught driving with just a learners licence and without a driver next to you.
 
No but the penalty is pretty harsh afaik. Blocked from taking the drivers for a few years iirc.

So don't do it.
 
As with driving without a license in this country, getting caught is not really that likely and a bribe can often suffice to get you off the hook. The most likely way that things can go wrong is that you can be involved in an accident, not necessarily your fault, in which case you will be held responsible and to compound matters, your insurance will tell you where to get off.
 
A friend of mine was caught like that. I was the passenger and didn't have a license.
It was police that stopped us though. Anyway, they let him off with a warning.

Um...court summons with a charge of driving with out a licence. I sat in a court case that involved that. The guy got off with a R400 fine :wtf:

It all depends where you get caught.
 
3-4 years ago when was in matric drove to school (past Police station) and home again everyday alone and was never caught... Only had Learners License, ill admit it is wrong but it is 5km away. so really close and didnt go close to any traffic.

like the guy say it all depends. i live is very quiet area so people couldnt really care less and i wasnt only one doing it. 2 other friends were doing the same :0 hahaha
 
I dont think I know anyone who has been arrested by police, but traffic officers are very strict in Cape Town.
 
33-34 years ago when I was in matric I drove to the shops a couple of km away, and got stopped and fined for not having a license. It was less than 5km away. There was no summons or court case, it was purely an admission of guilt and a fine. I got my license about two weeks after that.

It usually works like that.... and then one silly thing and you're screwed.
I know of a guy that had his learners... wanted to reverse the direction of the family car in the driveway.... reversed out, smack bang into a police car. Obviously he didn't have a licensed passenger next to him, so he was screwed. Ok, admittedly the chances of this happening is small, but it does happen.

To answer the OP... if you drive with a learner's as you've mentioned, and you're in an accident, and the other party is seriously hurt or killed, you're royally screwed.

This. Should be enough to make you stop, you'll be charged more seriously and everything will become your fault even if the other skipped a red light. I wouldn't risk it.

Exactly. I have two friends that were involved in fatal accidents and were unlicensed. Neither were at fault in the accidents but both were in a world of schit for a very long time. My one friend almost went to jail. If you don't have a license or are alone with just a learners you are at fault.

How did they manage to avoid jail? Was under the impression a fatal accident with only a learners was a ticket straight to jail

Good lawyers. Both were released on bail and later received suspended sentences.
 
After any accident with fatalities the police will open a culpable homicide docket. A hearing is usually held in the magistrate's court to determine whether charges will be levelled against the drivers involved, and if so there will be a court case. My understanding is that culpable homicide in a car accident is usually given a suspended sentence and a hefty fine (R10 000 - R20 000) if found guilty.

yeah i agree... if look back at it i wouldnt of taken the risk as well... the one week i was is bike accident and crushed my Hip but then i was still driving to school when i could. but because i was still taking meds and stuff i could of easily been in an accident but thats taking very far... i wouldnt take risk now as there are lately plenty more police everywhere. and people just drive stupidly lately

Damn, where do you live? In the Helderberg basin there are numerous unexpected roadblocks and vehicle/driver checks. We have unmarked police cars / motorbikes. We even have anti-drug units on patrol so don’t look dodgy in this area… On weekends the cells are propped with drunk drivers, beware to drive unlicensed and over the limit. Don't even try to bribe cops here; you don't know which side they are on.
