I recently resigned from a company and they refusing to pay me out my leave still owed to me (22 days), Does anyone know what Department of Labour office or website or something where I can lodge a dispute and get them on the case ? Would CCMA do this sort of thing ? Am a bit lost here...

Are they choosing to only pay you for 15 days or none of your leave days?

They don't want to pay me for any of them.

The reason was no funds available to pay out for my leave, I have already left - finished up in March and have been waiting ever since...

Yeah no, thats not a valid reason...

They are legally obliged to pay you for those days, regardless of what they want to think. DoL would be your first point of call.

Just walk into your nearest CCMA office and lodge a dispute. They will definitely hear this.

Leave can't be withheld, for any reason.

If they can't afford it, ask what payment plan they intend on offering if you want to be nice.

Nice one, thank you all. I'll see if CCMA can help.

sounds like OP works for cr@ppy people.
Colleagues of mine who worked during LVL5 didn't get anything, even though other Departments got.
they had to hustle, didn't get TERS, (even though they claimed it on their Behalf)
they got told they can take a loan, and got F****,

so OP, not surprised to hear they cant pay you out,
people love taking fat chances and thinking take it or leave it.
its the new SA way,

like so many others out there,
still have colleagues who worked during Lvl 5 lockdown and didnt get a cent up till now.
no TERS nothing.
Why would someone who worked during lockdown qualify for TERS?

Exactly. TERS is only applicable where income was reduced or not received.

100%, and if these employees know that the employer claimed TERS on their behalf and didn't pay it over why have they not reported the employer to UIF and SIU?

Can also very easily be verified, TERS websites allows you to see a employers claim for employees and how much. An employer has to also submit proof that it was paid over or are liable for very very heavy fines and possible jail time.
