If your phone is off for a certain period is there a maximum time the network retains messages while its off?

Say someone sends a text to my phone January 12th and my phone is off till January 28th will the sms still be received?

is there a max pending delivery period?
 
Yes. I was in the UK for a month without roaming and came back to nothing, just an announcement on my voicemail that "some messages have exceeded their storage time and have been deleted from your mailbox". The sms's announcing the missed calls never came though.
 
Depends on the settings on the senders cell, Message Validity can be set.

1 hour
6 hours
24 hours
3 days
1 week

This is a good question and I've often also wondered about this.

I think Maximum Time is a network setting. Anyone know how long that is?

Must be. I've seen maximum time being over a month (on Vodacom network)
Was overseas for 5 weeks, came back and SMS sent on the day of leaving were then delivered.
