Harris argued that rooted modems were legal, and he should not be responsible for what users did with the modems.

Yeah right...

It's like helping somebody carrying away groceries for free without paying...

seems a bit ridiculous as even telkom can limit accounts regardless of the modem settings ....
also, you can bypass some of that stuff using SSL .... he should argue that anyone using SSL is doing the same then as the ISP cannot throttle them either

this is in the USA where they have 'cable' and everything goes through this, television (like dstv) and their internet.
'rooted' dsl modems would not help at all in south africa.

Why would they want to have such a modem?, when I was in Detroit a few years back, I lived with average income people and even their internet connection were 24Mbps, I was downloading a file at 2400kBps which is faster than we can even get here with ADSL, and yes, they were already throttled for doing like 800Gb that month, when they are unthrottled they get the full 24Mbps speed (the download speed is 3000kBps then).

So it just wont make sense to have that modem.

I see he will appeal. After seeing that a few of the jury also could not see that a crime was committed, he might have a real chance for the appeal.

Because you get a bundled package that gives you TV and internet on the same box and it's cheap.
