Man killed during East Rand robbery

A man has been arrested for killing an alleged burglar and wounding his accomplice on Thursday in Thokoza, east of Johannesburg, Gauteng police said.

Five men allegedly broke into a spaza shop in the early hours of the morning, Lieutenant Kay Makhubela said.

The shop is in the man's yard. He heard a noise and decided to investigate.

Upon discovering the group of alleged burglars he shot at them, Makhubela said.

"He got out [of the house] and shot at them leaving one dead and another injured."

The group of four, including the wounded man, managed to flee the scene.

"Around 8am they were traced and arrested in one of the houses in the area," Makhubela said.

The man was found in possession of an unlicensed firearm belonging to the Johannesburg metro police department.

He was arrested for alleged murder, attempted murder and possession of an unlicensed firearm.

All five men would appear in the Germiston Magistrate's Court soon, Makhubela said.

The group of four faced a business burglary charge.

Will Johannesburg metro police department also face charges as the firearm does belong to them?

The fail is strong in the article, unless the gun nuts have been pulling porky pies all this time in regards to what an 'unlicensed firearm' is.

a firearms is licensed to someone, if you have any gun that requires licensing that is not yours it is unlicensed. I beleive that you can even have an exact type of the gun that is licensed to you and it would be deemed an unlicensed fire arm. that gun with that serial is licensed to you!

does it make sense now?

So what is the difference between an unlicensed firearm and a stolen firearm then?

honestly, no idea, maybe you have a point there then...dunno.

someone with a licensed firearm can have it stolen, but yeah does that then make the person who stole it in possession of an unlicensed firearm? or it a stolen licensed firearm.

If your firearm is stolen, you are legally obliged to report it as stolen to the nearest police station (its also a good idea to report it as stolen to your local police station as well).
A case (with case number) is then opened with details of the theft (firearm detail, serial number/s was ammunition taken as well, the list goes on).
The firearm registry is meant to be updated and the gun/serial number flagged as stolen and associated to a the case number you get when you report the firearm stolen.

Being in possession of a stolen firearm is illegal.
Being in possession of an unlicensed firearm is illegal.
Being in possession of a firearm with no serial number or tampered with serial number is illegal.
Not reporting a stolen/lost/missing firearm is illegal.

So then in this case, it was a licensed gun stolen or 'borrowed' from the Metro Police? An unlicensed gun then as I understand it refers to a gun which has never been on the firearm registry?
