MBD debt collectors.

I bought a brand new prepaid SIM the other day.
Guess what, they are harassing me on that, looking for someone else. They phone up to 15 TIMES A DAY.

Hopefully it is. When they play it back the magistrate will hear that I was provoked by their constant shouting and not letting me get a word in. This is abuse and harassment. Not allowed by the Debt Collectors Council.

I've been getting SMS's from these guys about some ABSA account that should be settled etc.
I have never had an ABSA account or even dealt with them.

Should I be worried or can this be ignored?

I will mail ABSA accounts department to make sure nothing has been taken out in my name.
I get calls about an FNB account. They always ask me for my ID number. I tell them to f**k off and go and ask the people they got my details from. Don't entertain those sorts of calls.
 
just got a call from them regarding a Telkom account that i cancelled 3 years ago.

Told her that if they called me again i would lay charges of harrasement, the line went dead immediately
 
Amendments to the National Credit Act (NCA), gazetted on Friday (13 March), will make it impossible for ‘unscrupulous’ debt collectors to collect debt that has expired.

The changes to the act will mean that if a consumer had not acknowledged a debt for more than three consecutive years either verbally or in writing the debt was considered prescribed and had effectively lapsed.

Prescribed debt is old debt that has not been acknowledged or paid.

Neil Roets, CEO of debt management company Debt Rescue warned consumers that if any payments have been made within those three years the debt will remain valid.

“You should also not have promised to pay. The creditor should also then not have summonsed you for this debt within three consecutive years,” Roets said.

“We have seen a slew of last-minute attempts by debt collectors and creditors to collect debt that had long since prescribed in the hope of beating the implementation of the new law.”

Roets said he expected the new amendments to have a significant effect on the use of emolument orders or, as they are more commonly known, garnishee orders, because many of the debts that these orders had been issued for had long since prescribed.

The buying and selling of prescribed debt between companies who specialised in hunting down consumers whom they knew had no cause to repay their debt because it had prescribed was big business before the introduction of the amendments.

A major benefit for indebted consumers is the fact that the amended act now states that credit providers are not allowed to take legal action against a debtor once a court date had been set to place him or her under debt review.

“This strengthens the hand of debt counsellors in protecting consumers and makes debt review the procedure of choice for consumers to lighten their debt load,” Roets said.

Among the other changes made by the amendments is that it also significantly increases requirements for affordability assessments done by lenders before granting loans to consumers.

“This is going to make unsecured credit much more difficult to access for cash-strapped consumers,” he said.

This morning before 07h30 they called our house telephone number looking for my sister. The damn woman on the phone was so aggresive. Besides mispronoucing my sister's name, she seemed proud to work for this company.

MBD Attorneys used a clever trick to make me "revive" a prescribed debt that is 15 years old.
The method they used was this;

I have a judgment against me from Standard Bank from 15 years ago that I pay diligently. My debt has been resold twice and the banking details have changed. MBD have changed banks before and sent me details via SMS as to the new banking details.

On the 24th July this year, they sent me an SMS stating "Banking Details as Follows". They changed from FNB to Standard Bank with a new reference number . So I paid my next payment into that account with the "new" ref.

Then on the 24th August I received another SMS stating "Banking Details as Follows" Still Standard Bank BUT my OLD reference number. So once again, I paid as instructed.

Immediately after this the barrage of calls started. It was verbal abuse. They accused me of not paying my account. I was dumfounded as I always pay and have never missed a month in 15 years. I could not get a word in the way he was shouting.

A few days later, I got an email with an attachment. Opened the file and it is a R5 000 debt from Standard Bank dated 2005. I have had no dealings with that bank since the 1999 judgement.

I have never been summoned or even been told of this "new" debt. Then it struck me. They conned me to revive a prescribed dept by making a payment into it.

Now they keep phoning at all times of the day and night saying it is not prescribed anymore and I must pay. They have sent me a legal looking form stating that they are to take legal action against me.

I know nothing about this account but now must pay it.
You have me totally intrigued. What debt did you have to still be paying it off after 15 years? I hope it's for your house :O
 
I have no idea what that "new" debt was for. I then put their con scheme on paper with all the proof and a flash drive of a recording with their agent shouting and threatening me. Sent it to them and that was the last I heard of it.

I think you mean prescribed debt.
Either way, ask for proof of the debt - they should be able to provide it
