Microsoft faces Vista trademark challenge

Ha Ha either he really hates microsoft or he had his head in a bag for quite a while.
 
lol another n00b trying to cash in. Thats like sueing another company for using the words "do", "just" or "it" because Nike have copyrighted its slogan "Just do it" :rolleyes:

Considering he hasn't launched the channel yet, Microsoft should sue HIM because people will inevitably think the channel is about Windows Vista, thus diluting the trademark.

Or something.

Nope, he got his trademark registered before Microsoft did.
 
Looks like MS's getting a taste of their own vile medicine. With MS chosing to file patent infringments against Linux only now after waiting for large scale implementation. But seriously, aren't there any global databases that have these registered trademarks logged and tracked. Much like when registering for a domain name: "Sorry, but that word is already a registered trademark. Please think of something else." Will save a lot of hassle. Or is it left open ended so situations like this can be taken advantage of?
 
"Tele Vista" and "Vista" are not the same. Besides, there are hundreds of "vista's" out there, just do a quick google :]

I really feel stupid after all the hassles to get the trademark on "longhorn" ;) prior to its release but unlucky for me Microsoft changed its name to Vista.
 
How can they put an exclusive tradmark on any single English language word? If they want to incorpoarate words into a unique phrase, that's fine. But a single word like Vista? or for that matter, Windows? That should be strictly public domain.

Tele Vista? Microsoft Vista? Those both have merit as trademarks. But neither should have the exclusive right to the word "vista".

If Microsoft called its operating system TeleVista then the case would have merit.

But regardless, one outcome is certain, it is going to be another great payday for the lawyers.
 
it will never stand up. he should have start court proceeding months and months ago when MS officially announced the name. he's just trying to milk the french cow!

Agreed. They registered the name Windows Vista / Microsoft Windows Vista, or were supposed to at least. I cannot see anyone Registering just plain "Vista" and getting away with it.

But we must look at this more carefully. Because one get:
  1. © is a set of exclusive rights regulating the use of a particular expression of an idea or information.
  2. ™ is a distinctive sign or indicator of some kind which is used.
  3. ® is the same as ™ according to Wikipedia.

Any more of these? And as far as I know each of these means something else. So they could get a ™ on “Vista” easily without infringing the rights of anyone if I understand this correctly.

The trade mark office in any country would only register the trade mark "Tele Vista" if the applicant did not agree to the non-exclusive use of the words "Tele" and "Vista" and only agree to the exclusive use on "Tele Vista".

® is not the same as ™

™ is an indication that there is an application made for the registration of the trademark and during this period the applicant may only use the ™

® or ™ is used with the registered trademark and ™ is ussually used after registration if the applicant forsee short term changes to the trademark
