I'm urgently looking for EOL or older (cheaper) Microsoft server software. If you happen to have any of these lying around or you know that perhaps your company/employer might have these and upgraded or for whatever reason isn't using them anymore, please could you let me know!

Microsoft Windows Server 2003
Microsoft Windows Server 2008
Microsoft Windows Server 2008 R2

Microsoft SQL Server 2000
Microsoft SQL Server 2005
Microsoft SQL Server 2008

Please note, must be 100% legit, with supporting paperwork/licence/key etc.

I always thought you had to register server software.

Of course you do, but once you no longer need it (decommissioned server or upgrade to newer version) the software licences are fully transferable (unless it was OEM, in which case it's tied to the box).

I never said untouched, I just said no longer in use

The resale of Licenses is expressly prohibited
Seems its as legal as getting them off a torrent site. Unless you're transferring them from an affiliate or through a merger / acquisition.
Why pay for something that's not legal in the first place....

The article above contradicts a Microsoft article I read a few weeks ago (will post it if I can find it), which prompted me to investigate this method of acquiring EOL software.

Either way, it's very different to downloading a torrent - at the very least the ethical interpretation of buying 2nd hand software for actual money differs to stealing software via torrents.

I will engage with MS and get clarity on this.

Tell me about it... if resale isn't permitted, then it would take my already pathetically low opinion of MS down to a level that cannot be described in a public forum.

Before the transfer, that party must agree that this agreement applies to the transfer and use of the software. The transfer must include the software and the Proof of License label. The first user may not retain any instances of the software unless that user also retains another license for the software.

For Server 2008 R2 OEM:

TRA NSFER TO A THIRD PARTY. You may transfer the software only with the licensed server, the Certificate of Authenticity label, this agreement, and CALs, directly to a third party. Before any permitted transfer, the other party must agree that this agreement applies to the transfer and use of the software. You may not retain any instances of the software unless you also retain another license for the software.
