Just an update on this.- plus I need to vent further ....
He paid the other 20% owing on the July rent a few days later and we issued an eviction letter asking him to leave by end August 2009. He then goes to his lawyer who advises him of his squatting rights and has the *cheek* to offer me two options :
1. They'll leave end August 2009 as requested, but will not pay rent (deposit covers). The issue with this if water and lights - and also any damage that is caused is extra (though I'll list him as non-payer in this case)
2. Both parties can try again, sign a debit order for the 1st and run it for the remainder of the lease with no further issues.
I selected option 1 and said I just wanted him out ; I'll forfeit the money, as long as he gets out. He agreed he'd leave, the house was advertised and all seemed great.
Two days ago the agent took someone look at the house and there was no sign of moving - nothing packed etc. I asked her to confirm what the guy was planning and a massive surprise, he couldn't get a place for September and requested another month.
With my permission the agent and I agreed that if stays, the money for August needs to be in my account by COB today (this was discussed yesterday).
The tenant said he couldn't make today and will deposit on Thursday. I have not chatted to him for a few months because I get highly aggitated - BUT this time I was fuming with his negotiations and decided to phone him directly.
I said to him NO MORE NEGOTIATING - either COB today or get the **** out the house by end August. I'm not accepting other dates or excuses. After fighting and arguing over the phone, he agreed to leave end August.
I foresee drama over the weekend as I doubt he's going to move (or he'll trash the place) - so I've decided that if he's still there, I'll hold a braai/party with loud music on the property and get a few roudy guys get drunk etc.
I may even get a few guys to stay on the property in the backroom *shrug*
